Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to reflect advancement to Aircrewman Mechanical First Class (AWF1)/E-6 effective 16 November 2017 and change paygrade to E-6 vice E-5 on 20 August 2019 enlistment. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 20 May 2021 and, pursuant to its regulations, determined that the partial corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner’s Individual Profile for the February 2017 (Cycle 100) Navy Wide Advancement Exam (NWAE) dated 2 June 2017 reflects passing and advancement effective date of 16 November 2017. b. On 4 June 2017, Navy Operational Support Center Sacramento issued Petitioner the “Authority to Assume the Title and Wear the Uniform of a Petty Officer First Class”. c. Petitioner’s Inactive Duty Training (IDT) Detail Review, reflect February 2018 through April 2018 drills (12 IDT periods) were adjudicated as authorized absences. d. Petitioner was discharged on 17 April 2018 at his expiration of obligated service. e. Petitioner signed DD Form 4, Enlistment/Reenlistment Document to enlist in the Navy Reserve on 20 August 2019 in paygrade E-5 for a term of 6-years. f. On 12 May 2021, Naval Education and Training Professional Development (NETPDC) confirmed Petitioner should have been advanced to Aircrewman Mechanical First Class (AWF1)/E-6 effective 16 November 2017 from February 2017 (Cycle 100) NWAE. Additionally, NETPDC verified no correspondence received to rescind or make changes to the advancement. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request does not have merit and warrants unfavorable action. A copy of which was previously provided to Petitioner for comment; however, a rebuttal statement was not received. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an error warranting the following corrective action. The Board concluded per reference (b), an administrative error occurred prior to Petitioner separating from the Naval Reserve on 17 April 2018. The Board felt, under these circumstances, partial relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner advanced to AWF1/E-6 effective 17 November 2017. Note: This change does not amend Petitioner’s 20 August 2019 enlistment in the paygrade of E-5. Defense Finance and Accounting Service will complete an audit of Petitioner’s pay records to determine retroactive pay and allowance entitlements from 16 November 2017 through 17 April 2018. The part of Petitioner’s request for corrective action that exceeds the foregoing is denied. The Board determined, there were no guarantees Petitioner would have been authorized to enlist in paygrade E-6 upon re-affiliating with the Navy Reserve on 20 August 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy. 6/25/2021 Deputy Director
