Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and entitled to the Aircraft Maintenance Kicker. 2. The Board, consisting of Ms. , Mr. and Mr. , reviewed Petitioner’s allegations of error and injustice on 17 June 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 9 May 2016, Petitioner entered active duty with an ECC of 8 May 2021. c. In accordance with reference (b) [30 June 2020], this bulletin announces the SRB program and the BSSRB program authorized for FY21. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 7 July 2020 are eligible for the FY21 SRB program. This will include: any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2020 to 30 September 2021. Corporals through Gunnery Sergeants in Zones A, B, or C within the 60xx, 61xx, 62xx, 63xx, or 65xx MOSs holding current qualifications and Necessary MOSs (NMOS) of 6012-Safe For Flight (SFF) Controller, 6016-Collateral Duty Inspector (CDI), 6017- Collateral Duty Quality Assurance Representative (CDQAR), or 6018-Quality Assurance Representative (QAR), in the below MCCs who reenlist for 48 months, and agree to remain in a specified MCC for the first 24 months (following the end of their current contract), will rate a 20,000 dollar kicker in addition to the PMOS bonus amount listed in section(s) 3.l, 3.m, and 3.n. If no PMOS bonus is listed in section(s) 3.l, 3.m, and 3.n, the Marine rates a lump sum kicker of 20,000 dollars. MCCs Authorized for Aircraft Maintenance Kicker: “…1TS, 1TV.” Zone A applies to those active component Marines with 17 months to 6 years of active military service. Zone A PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.i). Furthermore, a zone “A” SRB for MOS 6288 E-4, which is capped at $22,500 for 48 months of additional obligated service. d. On 29 July 2020, Petitioner’s 1st Term Active Duty Reenlistment request was submitted, and was approved by HQMC on 25 November 2020. e. On 23 October 2019, Petitioner transferred from Beaufort, SC (MCC 1TV), and arrived to Beaufort, SC (MCC 1TS) on 24 October 2019 for duty. f. On 1 November 2020, Petitioner was promoted to Corporal/E-4. g. On 4 December 2020, Petitioner reenlisted on for 4 years and 6 months with an ECC of 3 June 2025. Furthermore, received both a SRB and Early Reenlistment Kicker. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that due to no fault of his own, Petitioner received the FY21 Early Reenlistment Kicker, instead of the FY21 Aircraft Maintenance Kicker which is much higher. Only one kicker may be obligated per Marine. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Paragraph B8b (Remarks) of the DD Form 4/1 executed on 4 December 2020, listed the following: REENLISTED FOR THE FOLLOWING INCENTIVE(S): ZONE A SRBP AMOUNT $42,500. PER MARADMIN 376/20 THIS MARINE IS ELIGIBLE FOR AN AIRCRAFT MAINTENANCE KICKER IN THE AMOUNT OF $22,000, LESS APPLICABLE STATE ANO GOVERNMENT TAXES. Note: This change will entitle the member to a zone “A” SRB for MOS 6288, which is capped at $22,500 for 48 months of additional obligated service. Remaining obligated service to 8 May 2021 will be deducted from SRB computation. Furthermore, Petitioner is entitled to an Aircraft Maintenance Kicker in the amount of $22,000. Finally, Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
