Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish entitlement to Enlistment Bonus for College Credit (EBCC). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 8 July 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), active component recruits that enlisted in any rate/program, and shipped in the months of October through September of any fiscal year, with 24-47 semester hours from a postsecondary accredited institution were eligible to receive $3,000 upon graduation from Recruit Training Command (RTC). b. On 26 April 2019, Petitioner enlisted in the Naval Reserve for a term of 8-years of which 4-years is considered an active duty obligation. NAVCRUIT 1133/52, Enlistment Guarantees – Annex “A” listed Equipment Operator (EO 5YO) Class “A” School Guarantee and Enlistment Bonus for RTC PFA (EBPFA) -$2,000 Bonus. Active Duty Service Date (ADSD) was 4 November 2019 per reference (c). c. Petitioner’s NAVCRUIT 1133/102, Enlistment Bonus Statement of Understanding backdated to 26 April 2019 reflects entitlement to EBCC -$3,000 and EBPFA -$2,000. d. transcript printed on 30 July 2019 indicates Petitioner earned 27 college credit hours; Spring 2018 -3 semester hours, Summer 2018 -3 semester hours, Fall 2018 -3 semester hours, Spring 2019 -9 semester hours and Summer 2019 – 9 Semester hours. e. Petitioner’s ADSD is 26 August 2019. f. Petitioner completed Recruit Basic Military Training on 26 October 2019. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the criteria to receive an EBCC prior to accession. However, NAVPERS 1133/52, Enlistment Guarantees – Annex “B” was not generated when ADSD changed from 4 November 2019 to 26 August 2019 and entitlement to EBCC was not captured in accordance with reference (b), thereby impeding Petitioner’s ability to receive the enlistment bonus. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: On 30 July 2019, Petitioner was issued NAVCRUIT 1133/52, Enlistment Guarantee -Annex “B” to DD Form 4 dated 26 April 2019 listing Option 1: Equipment Operator (EO 5YO) Class “A” School Guarantee; Option 2: Enlistment Bonus for RTC PFA (EBPFA) -$2,000 Bonus; and Option 3: Enlisted Bonus for College Credit (EBCC) -$3,000 Bonus. This change will entitle Petitioner to payment of $3,000 EBCC upon graduation from RTC. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
