Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner reenlisted for 4 years and was eligible for and received a Selective Reenlistment Bonus (SRB). 2. The Board, consisting of Ms. , Mr. and Mr. , reviewed Petitioner’s allegations of error and injustice on 17 June 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 3 June 2014, Petitioner entered active duty for 4 years with an EAOS of 2 June 2018. c. On 2 March 2018, Petitioner signed an agreement to extend enlistment for 38 months with an SEAOS of 2 August 2021 in order to incur sufficient obligated service to execute BUPERS order: 0258. d. In accordance with reference (b) [15 April 2020], This NAVADMIN announces revised selective reenlistment bonus (SRB) policy for Active Component (AC) and Full-Time Support (FTS), superseding reference (a). Sailors must now reenlist within 365-days of their end of active obligated service (EAOS) (as opposed to 270-days required in reference (a)), except in the case of Nuclear-trained Sailors who can reenlist at any point in the reenlistment zone, per guidance in reference (b). e. On 1 May 2020, Deputy Chief of Naval Personnel notified Petitioner that he was authorized immediate in-rate reenlistment in the Active Component (AC) component with an end date of August 2021. f. In accordance with reference (c) [20 August 2020], FY20 SRB AWARD PLAN (N13SRB 004/FY20) listed a zone “B” SRB with an award level of 1.5 ($30,000 award ceiling) for the AT rate with the following note: “The Navy Enlisted Classification (NEC) 0000, commonly referred to as quad zero, is listed here to establish that Sailors in these ratings/career fields can hold any or no NEC and still be qualified for the SRB provided they meet all.” g. On 21 August 2020, Petitioner signed a NPPSC 1160/1 (Command Career Request) requesting a 3 year reenlistment with an effective date of 25 November 2020, and SRB. Petitioner’s request was approved by cognizant authority on 3 November 2020. h. On 21 August 2020, COMNAVPERSCOM notified Petitioner’s command that SRB request was rejected because reenlistment must extend new EAOS into a new zone of eligibility. i. In accordance with reference (d) [28 October 2020], FY21 SRB AWARD PLAN (N13SRB 001/FY21) listed a zone “B” SRB with an award level of 0.0 ($30,000 award ceiling) for the AT rate with the following note: “The Navy Enlisted Classification (NEC) 0000, commonly referred to as quad zero, is listed here to establish that Sailors in these ratings/career fields can hold any or no NEC and still be qualified for the SRB provided they meet all other applicable non-NEC related criteria.” Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this publication. j. On 10 November 2020, COMNAVPERSCOM notified Petitioner’s command that SRB had been approved for a zone “B” SRB with an award level of 1.5 for the AT rate with a reenlistment date of 25 November 2020 for 4 years. k. On 25 November 2020, Petitioner reenlisted for 3 years with an EAOS of 24 November 2023. l. On 7 December 2020, COMNAVPERSCOM notified Petitioner’s command that SRB was cancelled because Petitioner failed to reenlist for 4 years. m. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action.. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that the reenlistment contract was prepared for a 3-year term vice 4-year term. Since the reenlistment term did not match the SRB authorization, the SRB was cancelled. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The immediate reenlistment contract (NAVPERS 1070/601) executed on 25 November 2020 was for a term of 4 years vice 3 years. Note: This change will entitle the member to a zone “B” SRB with an award level of 1.5 ($30,000 award ceiling) for the AT rate. Remaining obligated service to 2 August 2021 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy. 7/26/2021 Deputy Director
