After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 20 July 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations, and policies. In addition, the Board considered the advisory opinion contained in Bureau of Naval Personnel memorandum 1920 BUPERS-00B/ undated; a copy of which was previously provided to you for comment. You requested to update your DD Form 214, Certificate of Release or Discharge from Active Duty dated 1 February 1998. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that your DD Form 214 is correct in accordance with Marine Corps Order P1900.16E, Navy Military Personnel Command Instruction 1900.1B, and the Marine Corps Promotion Manual. A review of your record indicates you were enrolled in the United States Naval Academy (USNA) from 1 July 1987 through 25 June 1990; at which time you were disenrolled. You then served in the Navy from 26 June 1990 through 7 July 1991 in pay grade E-3 and was issued a DD Form 214 to reflect that time in service. Thereafter, you reentered USNA on 8 July 1991 and graduated on 17 August 1992. You were commission as a Second Lieutenant/O-1 in the Marine Corps on 17 August 1992, promoted to First Lieutenant on 17 August 1992 and after failing to select to a higher grade, you were released from active duty and transferred to the Marine Corps Reserve with separation pay in the amount of $18,386.56. On 1 June 2012, you were honorably discharged from the Marine Corps Reserve. In accordance with the aforementioned policies, service in the Naval Academy is not credible service time; therefore, not included on the DD Form 214. Additionally, the Board determined time in grade from O-1 to O-2 is 24-months in service, thereby indicating your promotion to First Lieutenant/O-2, 2-years after commissioning is correct. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
