Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to reflect reenlistment and advancement under the provisions of the Selective Training and Reenlistment (STAR) program in accordance with reference (b). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 20 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, she exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner advanced to Hospital Corpsman Third Class (HM3)/E-4 effective 16 September 2020. b. Petitioner assigned Navy Enlisted Classification (NEC) L23A effective 1 October 2020. c. On 2 October 2020, Petitioner reenlist for a term of 6-years for Zone “A” Selective Reenlistment Bonus - NEC L23A. d. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner earned NEC L23A effective 1 October 2020, thus meeting the eligibility criteria to reenlist and be advanced under the provisions of the STAR program in accordance with references (b) and (c). However, a STAR request was not submitted to the cognizant authority before reenlisting on 2 October 2020, thereby rendering Petitioner ineligible for STAR reenlistment and possible advancement. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: STAR program request was submitted and received by cognizant authority 60-days in advance of the Petitioner's requested reenlistment date; it was approved. Petitioner’s NAVPERS 1070/601, Immediate Reenlistment Contract effective 2 October 2020 for a term of 6-years is designated as a STAR reenlistment, “Career designated under MILPERSMAN 1160-100”. Note: Upon meeting advancement requirements of reference (b) and (d), with Commanding Officer’s favorable endorsement, Petitioner may be advanced to Hospital Corpsman Second Class (HM2)/E-5 effective 16 September 2021. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
