Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish Petitioner’s marital status and authorize appropriate Basic Allowance for Housing (BAH) entitlement. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 27 May 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. According with Petitioner’s electronic service record (ESR), Petitioner enlisted in Navy Reserve effective 13 February 2020. No enlistment contract in Petitioner’s Official Military Personnel File (OMPF). Petitioner’s ESR NAVPERS 1070/602 reflects Petitioner married to active duty spouse effective 17 March 2018 in . Address of spouse is in . b. Petitioner’s ESR and DD Form 214 effective 20 November 2020 reflects she entered active duty on 17 August 2020. Petitioner’s Master Military Pay Account (MMPA) reflects BAH Partial started effective this date. Petitioner in accession pipeline (Recruit training) . c. On 24 August 2020 Petitioner’s active duty spouse is released from active duty. Mailing address and nearest relative (Petitioner) address listed as . d. On 20 November 2020 Petitioner is discharged due to entry-level performance and conduct. Petitioner’s BAH unchanged with no entitlement to BAH at with dependent rate while on active duty. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded per reference (b) Petitioner entitled to BAH at dependent rate after her active duty spouse was release from active duty on 24 August 2020. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner authorized BAH at dependent rate for dependents location zip code effective 25 August 2020 through 20 November 2020. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
