Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received the 72 Month Lateral Move (LM) Initiative or reduce reenlistment term to 48 months. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 2 March 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 11 May 2015, Petitioner entered active duty. c. In accordance with reference (b) [2 July 2018], This bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2018 to 30 September 2019. Zone A Marines electing to LM in FY19 into PMOSs listed in section 3.m with the LM designation, will be given the opportunity to reenlist for 72 Months. Marines who execute a LM into one of these PMOSs for 72 months will rate a 40,000 dollar initiative in addition to the PMOS bonus listed in section 3.m. The LM initiative may not be coupled with any kicker. Zone A applies to those active component Marines with 17 months to 6 years of active military service. First term Marines with exactly 6 years of active military service on the date of reenlistment may be paid a Zone A PMOS bonus if they have not previously received a Zone A PMOS bonus. Zone A lateral move PMOS bonus payments are only authorized for those PMOS(s) designated with LM. Marines who already hold a PMOS with a LM designator and are in Zone A will rate the PMOS bonus listed below. Zone A PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.j). Furthermore, a zone “A” SRB for MOS 6338, Corporal/E-4, $27,000 was authorized. d. On 6 December 2018, Petitioner’s 1st Term Active Duty lateral Move request was submitted for 48 months, and was approved by HQMC on 18 January 2019 for 72 months. e. On 23 January 2019, Petitioner reenlisted for 6 years. f. On 1 November 2019, Petitioner was promoted to Sergeant/E-5. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has no merit and warrants no action. h. On 23/26 February 2021, Petitioner’s email stated that if his original request is disapproved, then a change in term is requested to reflect an end of active service (EAS) of 22 January 2023 vice 22 January 2025. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following partial corrective action. The Board concluded that Zone A lateral move PMOS bonus payments are only authorized for those PMOS(s) designated with LM. Petitioner’s PMOS was not designated for LM; therefore, Petitioner is ineligible for the 72 Month Lateral Move (LM) Initiative. However, the Board agreed to change Petitioner’s reenlistment contract to 48 months vice 72 months. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The enlistment/reenlistment document (DD Form 4) executed on 23 January 2019 is for a term of 4 years vice 6 years. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
