Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received a Selective Reenlistment Bonus (SRB). 2. The Board, consisting of , , and reviewed Petitioner’s allegations of error and injustice on 17 June 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 6 September 2007, Petitioner entered active duty. c. On 11 April 2014, Petitioner reenlisted for 6 years with an EAOS of 10 April 2020 and SEAOS of 10 September 2021. d. In accordance with reference (b) [2 December 2019], this NAVADMIN announces revised selective reenlistment bonus (SRB) award levels and reenlistment policy for Active Component (AC) and Full-Time Support (FTS), updates to the pay for performance pilot (a Sailor 2025 initiative) and changes to how future SRB award levels will be announced. Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Sailors must reenlist within 270-days of their end of active obligated service (EAOS), except in the following cases: a. Nuclear-trained Sailors. b. Sailors who must obligate service (OBLISERV) to execute a permanent change of station move will be allowed to reenlist early any time within 1 Calendar Year of the detachment month, but not later than the date of detachment from the last intermediate duty station. Commands are required to submit SRB reenlistment requests to BUPERS-328 via OPINS or NSIPS 35 to 120 days in advance of the requested reenlistment date of the Sailor. Requests submitted less than 35 days prior to the requested reenlistment date will be rejected. However, commands may contact BUPERS-328 for waiver eligibility and procedures. Furthermore, a zone “C” SRB for the IT rate was not authorized. e. In accordance with reference (c) [15 April 2020], this NAVADMIN announces revised selective reenlistment bonus (SRB) policy for Active Component (AC) and Full-Time Support (FTS), superseding reference (a). Sailors must now reenlist within 365-days of their end of active obligated service (EAOS) (as opposed to 270-days required in reference (a)), except in the case of Nuclear-trained Sailors who can reenlist at any point in the reenlistment zone, per guidance in reference (b). f. In accordance with reference (d) [20 August 2020], FY20 SRB Award Plan (N13SRB 004/FY20) was published listing the following: a zone “C” SRB with an award level of 0.5 ($30,000 award ceiling) for the IT rate was authorized with the following note: The Navy Enlisted Classification (NEC) 0000, commonly referred to as quad zero, is listed here to establish that Sailors in these ratings/career fields can hold any or no NEC and still be qualified for the SRB provided they meet all. g. On 20 October 2020, Petitioner signed a NPPSC 1160/1 (Command Career Request) request for a 6 year reenlistment effective 7 December 2020, approved by cognizant authority on 5 November 2020. h. In accordance with reference (e) [28 October 2020], FY21 SRB Award Plan (N13SRB 001/FY21) was published cancelling the zone “C” SRB for the IT rate in 30 days. i. On 25 November 2020, Commanding Officer, US Central Command notified Director, Military Personnel Plans and Policy Division (OPNAV N13) requesting 35 day waiver based on the divisional counselor informed the CCC that he was unaware of the submission requirement and did not have access to the upload program required for SRB submission. Furthermore, The improper submittal of the SRB request was sole responsibility of the command team. j. On 7 December 2020, Petitioner reenlisted for 6 years with an EAOS of 6 December 2026. k. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner submitted his reenlistment request in a timely manner; however, the command failed to submit the SRB precertification request to BUPERS-328 within 35 days in advance of his requested reenlistment date. Due to no fault of Petitioner, reference (e) was published while his request was being processed and he reenlisted after the SRB had been cancelled. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 25/26 November 2020 vice 6/7 December 2020 for a term of 6 years. Note: This change will entitle the member to a zone “C” SRB with an award level of 0.5 ($30,000 dollar award ceiling) for the IT rate. Remaining obligated service to 10 September 2021 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy. 7/23/2021 Deputy Director
