Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner’s immediate reenlistment contract reflect branch class 32 vice 11, and that he advanced to Petty Officer Second Class. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 23 February 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 8 July 2014, Petitioner enlisted for 8 years in the U.S. Naval Reserve with the option of Full Time Support Aviation Machinist’s Mate (FTS/AD) Class “A” school. c. On 3 December 2018, Deputy Chief of Naval Personnel notified Petitioner that he was authorized immediate in-rate reenlistment in the FTS component. Furthermore, Petitioner was advised to utilize his reenlistment authorization before the end of March 2020. d. On 1 May 2019, Petitioner submitted a Command Career Request (NPPSC 1160/1) for 6 years effective 3 July 2019. It was approved by cognizant authority on 22 May 2019. e. In accordance with reference (b) [14 May 2019], this NAVADMIN announces the September 2019 (Cycle 244) Navy-wide Advancement Examinations for advancement in rate of Active, Full-Time Support and Canvasser Recruiter Sailors for E-4, E-5, and E-6. f. On 3 July 2019, Petitioner reenlisted for 6 years in the U.S. Naval Reserve (FTS) g. On 12 September 2019, Petitioner participated in the September 2019 (Cycle 244) Navy-wide Advancement Examinations and was selected for advancement. h. On 16 June 2020, Petitioner was advanced to AD2/E-5. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner was erroneously reenlisted under the wrong branch class. Furthermore, Petitioner correctly took the appropriate Navy-wide Advancement Examination for advancement in rate, was selected, and advanced. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s immediate reenlistment contract (NAVPERS 1070/601) executed on 3 July 2019 for 6 years listed a branch class of USNR/32 vice USN/11, I am reenlisting in the U.S. Naval Reserve vice U.S. Navy, and a RADO MONTHS/DAYS of 072/000 vice 000/000. Note: Navy Personnel Command will review Petitioner's Official Military Personnel File for possible removal of additional immediate reenlistment contract with the same effective date. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
