Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner received official change duty orders (BUPERS order: 3070) prior to the execution of his Household Goods (HHG) move. 2. The Board, consisting of Ms. Ms. and Mr. reviewed Petitioner’s allegations of error and injustice on 12 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), HHG allowances are based on the PCS order’s effective date; although, the HHG may be transported as long as the HHG authority remains in effect. The weight allowance is based on the grade held on the effective date of the order authorizing the HHG transportation. c. On 28 August 2020, Petitioner received an invoice from PODS for contents protection while in transit fee, weight ticket empty, delivery empty container to your location, contents protection $10,000 value – monthly fee, and monthly rental of container in storage center, for a total of $503.84. On 2 September 2020, Petitioner received an invoice from PODS for transportation mileage, for a total of $3,282.17. On 4 October 2020, Petitioner received an invoice from PODS for contents protection $10,000 value – monthly fee, for a total of $317.94. On 4 October 2020, Petitioner received an invoice from PODS for weight ticket full, for a total of $43.10. On 10 October 2020, Petitioner received an invoice from PODS for redeliver container to your location, for a total of $140.08. d. On 12 October 2020, Petitioner received a weigh master certificate from Sullivan Moving and Storage Company with a gross of 28,760lbs. The carrier was PODS. e. On 2 November 2020, Petitioner was issued official change duty orders (BUPERS order: 3070) with an obligated service of December 2023, and ultimate activity of for duty. f. On 1 December 2020, Petitioner departed , and arrived to for duty. g. On 15 December 2020, Petitioner’s application for Do It Yourself Move and Counseling Checklist was issued and certified by counselor with an estimated gross incentive of $13,284.16 from to . Petitioner signed the form on 20 December 2020. h. On 31 December 2020, Petitioner completed a Personally Procured Move (PPM) Checklist and Expense Certification certifying that the expenses were legitimately incurred during his personally procured move in December of 2020 for a total of $5,045.83 from to . i. On 31 December 2020, Petitioner completed a Travel Voucher or Sub-Voucher for accompanied travel conduced from to from 20 November 2020 to 26 November 2020. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded even though Petitioner began execution of HHG PPM prior to issuance of orders, he had reason to believe orders would be forthcoming. Due to COVID-19 and family considerations, Petitioner felt forced to initiate his move early in order to execute the move with as little difficulty as possible. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was issued official change duty orders (BUPERS order: 3070) on 27 August 2020 vice 2 November 2020. Furthermore, Petitioner was authorized to submit Personally Procured Move (PPM). Note: Petitioner is advised to resubmit his orders, travel claim, all receipts, and a copy of this Board of Correction of Naval Records (BCNR) decision letter to the Household Good Audit Team (HHG-AT) for re-adjudication. Settlement of this travel claim is chargeable to the line of accounting on the Petitioner’s official change duty orders (BUPERS order: 3070). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
