ADDENDUM TO RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2001-01934 COUNSEL: NONE HEARING DESIRED: NO , APPLICANT REQUESTS THAT: Her Bad Conduct Discharge (BCD) be upgraded to a General (under honorable conditions) Discharge. STATEMENT OF FACTS: By virtue of a DD Form 149, Application for Correction of Military Record, dated 23 Aug 01, the applicant requested to have her BCD changed to an entry-level separation or uncharacterized. On 19 Dec 01, the Board considered and denied the applicant’s request due insufficient evidence to warrant changing the record (Exhibit E). By virtue of a DD Form 149, dated 3 Oct 14, the applicant is requesting reconsideration to have her BCD upgraded to honorable or general. The applicant states her discharge was unjust because it was based on one isolated incident in her 13 months of service. Since leaving military service she has completed her Bachelors and Masters degrees (Exhibit F). As background, on 8 Apr 98, the applicant commenced her enlistment in the Regular Air Force. The applicant was charged with theft of a diamond ring set, three driver licenses, three blank personal checks, government credit card, $100.00 and $600.00 from a bank. She was also charged with forgery of two checks for $300.00 each (which were used to obtain the $600.00 from the bank). The applicant was referred to a general court-martial. The applicant pled guilty and was convicted of one specification of forgery, three specifications of larceny, and one specification of wrongful appropriation all in violation of various articles of the Uniform Code of Military Justice (UCMJ). She pled not guilty to stealing the driver’s license, government credit card, $100.00, and the personal check of a third service member. She was convicted of stealing those items with the exception of $100.00. The applicant elected to be tried by a military judge for this specification. The applicant was sentenced to a BCD, reduction to the grade of E-1 and eight months confinement. The convening authority approved the sentence as adjudged. On 20 Sep 99, the Air Force Court of Criminal Appeals affirmed the findings and sentence. On 10 Feb 00, the United States Court of Appeals for the Armed Forces denied the applicant’s petition for review. On 11 Feb 00, the convening authority ordered the execution of the BCD. The applicant was furnished a BCD on 16 Feb 00, and credited with 1 year, 3 months, and 20 days of active service. She had 199 days of lost time. On 19 Feb 15, a request for post-service information and a Federal Bureau of Investigation (FBI) background check was forwarded to the applicant (Exhibit G). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: After again reviewing the evidence of record, the applicant’s prior submission, the additional evidence provided in support of her appeal, we are not persuaded that it would be appropriate to override the Board’s original decision. We remain unconvinced that the applicant’s contributions to the community since her discharge are sufficient to overcome the misconduct which formed the basis for her discharge. Therefore, while we commend the applicant for her post-service transition, we are not persuaded that it would be in the interest of justice to upgrade her discharge. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
