RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2007-03772 INDEX CODE: 107.00 COUNSEL: NONE HEARING DESIRED: NO _____________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Separation, be corrected to reflect award of the Air Force Outstanding Unit Award (AFOUA), Good Conduct Medal (GCM), National Defense Service Medal (NDSM), Air Force Longevity Service Award (AFLSA), and the Small Arms Expert Marksmanship Ribbon (SAEMR). _____________________________________________________________ APPLICANT CONTENDS THAT: In the haste of out-processing, his award data and additional retraining information were not included on his DD Form 214. In support of his request, applicant provided a copy of his DD Form 214 The applicant's complete submission, with attachments, is at Exhibit A. _____________________________________________________________ STATEMENT OF FACTS: The applicant served in the Regular Air Force from 16 Jan 63 to 13 Jan 67, a period of 3 years, 11 months, and 28 days. The applicant’s DD Form 214, Block 14, has been administratively corrected to reflect “Aircraft Maintenance Technician (KC-135) Course, 116 hrs, Dec 65.” The AFOUA is awarded by the Secretary of the Air Force to units that have distinguished themselves by exceptionally meritorious service or outstanding achievement that clearly sets the unit above and apart from similar units. The AFLSA is awarded to all members of the Air Force who complete four years of honorable active or reserve military service with any branch of the U.S. Armed Forces. The applicant did not serve a full four years which rendered him ineligible for the award. The SAEMR is awarded to all U.S. Air Force service members, who, after 1 Jan 63, qualify as expert in small arms marksmanship with either the M-16 rifle or issue handgun. These rules will apply to the Air Force standard service small arms weapon selected. Qualification as expert in both weapons after 22 Jun 72 is denoted by a bronze service star worn on the ribbon. _____________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial. DPSIDR states that after a thorough review of the applicant’s records they were able to verify his entitlement to the GCM and the NDSM. His DD Form 214 has been updated to reflect these medals; however, his units of assignment were not awarded the AFOUA and there was no documentation indicating he was awarded the SAEMR. The complete AFPC/DPSIDR evaluation is at Exhibit C. _____________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 1 Feb 08 for review and comment within 30 days (Exhibit D). As of this date, this office has not received a response. _____________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and note that his term of service would have ended on a Sunday but he was discharged for Convenience of the Government, on a Friday. The governing regulation at the time dictated that the member would be separated on the preceding weekday and entitled to pay through the actual date of separation. Therefore, had the applicant’s separation date not fallen on a weekend he would have completed his full four years. Therefore, we believe the applicant’s records should be corrected to the extent indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that he was awarded the Air Force Longevity Service Award. _____________________________________________________________ The following members of the Board considered Docket Number BC-2007-03772 in Executive Session on 10 June 2008, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
