His general (under honorable conditions) discharge be upgraded to honorable. 2. Or, in the alternative, his RE code be changed so he can join the Air National Guard (ANG). ________________________________________________________________ STATEMENT OF FACTS: On 22 September 2008, the applicant submitted a similar request. On 20 May 2009, his request was denied. For an accounting of the facts surrounding his previous request and the rationale of the Board's earlier decision, see the Record of Proceedings at Exhibit H. On 14 July 2009, the applicant submitted a letter requesting reconsideration. He states he is not trying to find the Air Force at fault, rather he is seeking clemency. It has been 14 years since his discharge and he wants to join the Pittsburg ANG. The applicant’s complete submission is at Exhibit I. ________________________________________________________________ THE BOARD CONCLUDES THAT: After again reviewing this application and the evidence provided in support of his appeal, the Board found no errors in the discharge processing and it appears the RE code assigned is appropriate and correct. The Board considered the applicant’s request on the basis of clemency; however, they did not find the evidence presented sufficiently persuasive to recommend granting the relief sought on that basis. It remains the opinion of the Board that the applicant has failed to sustain his burden of proof that he has been the victim of an error or injustice.
