RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2008-03457 INDEX CODE: 128.02 XXXXXXXXXXXXXXXXXXX COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: He be authorized an extension to his household goods (HHG) storage allotment from ninety days to twelve months during his short tour to Kunsan Air Base (AB), Korea. _________________________________________________________________ APPLICANT CONTENDS THAT: He was unable to properly relocate his family members to his follow-on assignment at Charleston Air Force Base (AFB), South Carolina (SC), and unable to get government housing until his completion of his remote tour in Korea. In addition, he was unable to purchase a house due to the cost and because he had an inadequate amount of time during his leave en route. He relocated his family to Tennessee near family members while he is away. In support of his appeal, the applicant provided copies of his request for a storage extension and his permanent change of station (PCS) orders. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving on active duty in the grade of technical sergeant (E-6) with a date of rank of 1 November 2007. He has a Total Active Federal Military Service Date of 2 May 1996 and a projected date of separation of 18 May 2013. The remaining relevant facts are contained in the evaluation by the Air Force office of primary responsibility at Exhibit B. _________________________________________________________________ AIR FORCE EVALUATION: JPPSO-SAT/ECAF recommends denial of the applicant’s request. ECAF states that per Special Order AB-063502, dated 6 June 2008, the applicant PCSd from Lackland AFB, Texas, to Kunsan AB, Korea, with a follow-on assignment to Charleston AFB, SC. Incident to the PCS, he effected a HHG shipment weighing 7,540 pounds to the follow-on location under Government Bill of Lading (GBL) , dated 20 June 2008. Upon arrival, the HHG were placed into storage-in-transit (SIT) for ninety days. The applicant submitted a request to JPPSO-SAT/ECAF for an extension of the storage duration of his one year tour at Kunsan AB, Korea, due to the cost of housing near Charleston, and the limited amount of leave he had to search for a residence for his dependents before his departure for Korea. He was advised by JPPSO-SAT/ECAF that they did not have the authority to extend the storage for the reasons presented. ECAF states that Paragraph U5350-C, Joint Federal Travel Regulation (JFTR) indicates that when a member is transferred by PCS to serve an outside of the Continental United States (OCONUS) dependent restricted tour, HHG transportation is authorized to non-temporary storage, or any place in CONUS the member designates. The applicant requested and received approval for a follow-on assignment to Charleston AFB, SC, after his PCS at Kunsan AB, Korea. Paragraph 3.2.2.2 of the Air Force Supplement to the JFTR advises that in order for a member to participate in the follow-on program, relocation of dependents and/or HHG is authorized to the follow-on location only. HHG should not be shipped to the follow-on location at government expense unless the member or the member’s agent can accept the HHG delivery upon arrival at the follow-on location. A period of SIT not to exceed ninety days may be authorized. When applying for the follow-on program, a member basically agrees to not expend government funds for the movement of dependents or HHG except for going directly to the follow-on location to be accepted immediately or soon thereafter. ECAF indicates that the applicant’s HHG should have been placed into non-temporary storage at origin if he could not accept delivery upon arrival at the follow-on location, even though it would have jeopardized the follow-on. The events associated with the storage of the applicant’s HHG shipment is based upon decisions he made for personal reasons. He has not presented any evidence indicating he was the victim of an error or injustice. The complete ECAF evaluation, with attachments, is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 January 2009 for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
