RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-00079 INDEX CODE: 112.10 XXXXXXXXXXXXXXXXX COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: Her reentry (RE) code be changed to allow her to rejoin the military. _________________________________________________________________ APPLICANT CONTENDS THAT: She does not feel that her actions ten years ago constitute the person she has evolved into today, and she would like the opportunity to prove it. In support of her appeal, the applicant provides a personal statement; a copy of her DD Form 214, Certificate of Release or Discharge from Active Duty; Enlisted Performance Reports; character references; letters of appreciation; letters of recommendation; college transcripts; and several education and training certificates of completion. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Regular Air Force who served on active duty from 14 July 1999 to 13 March 2003 in the Security Forces career field. She was progressively promoted to the grade of senior airman (E-4) effective 14 July 2002. A Mental Health Evaluation, dated 17 October 2002, indicates the applicant was referred for evaluation because she twice made suicidal attempts/gestures in the last year. She was found fit for duty; however, was diagnosed with Partner Relational Problems and Histrionic Personality Disorder. The Life Skills Flight Commander recommended the applicant would be better suited in a job that does not carry a weapon due to her thoughts of suicide. A Treatment Summary, dated 3 January 2003, indicates the Life Skills Flight Commander recommended the applicant be administratively separated from the Air Force because she was temperamentally and emotionally unsuited for active duty. On 15 January 2003, the applicant was notified by her commander that he was recommending her for an honorable discharge for conditions that interfere with military service under the provisions of Air Force Policy Directive 36-32, Military Retirements and Separations, and Air Force Instruction 36-3208, Administrative Separation of Airmen, paragraph 5.11.9, Mental Disorders. The applicant acknowledged her commander’s recommendation, consulted counsel, and submitted a statement in her own behalf. On 28 February 2003, the Staff Judge Advocate found the case to be legally sufficient and recommended the applicant be separated with an honorable characterization of service. On 10 March 2003, the discharge authority approved the recommended discharge and directed she be separated with an honorable discharge without probation and rehabilitation. The applicant was honorably discharged effective 13 March 2003 with an RE code of “2C” (involuntarily separated with an honorable discharge), and a narrative reason for separation of “Personality Disorder.” She served three years and eight months on active duty. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOS recommends denial. DPSOS indicates that based on the documentation on file in the master personnel records, the discharge was consistent with the procedural and substantive requirements of the discharge instruction and was within the discretion of the discharge authority. The complete DPSOS evaluation is at Exhibit C. AFPC/DPSOA recommends denial. DPSOA indicates the applicant has not provided any evidence of an error or injustice in reference to her RE code. The RE code “2C” is required based on the applicant’s involuntary separation with a honorable characterization of service per Air Force Instruction 36-2606, Reenlistment in the USAF, chapter 3. The complete DPSOA evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 15 October 2010, for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice that would warrant a change to the applicant’s RE code. After a thorough review of the evidence presented, we agree with the opinions and recommendations of the Air Force offices of primary responsibility that the RE code which was assigned at the time of her separation accurately reflects the circumstances of her separation, and evidence has not been provided that would lead us to believe otherwise.
