RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-00097 INDEX CODE: 131.01, 107.00 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: The reaccomplished Meritorious Service Medal, Second Oak Leaf Cluster (MSM 2OLC) be added to his records. _________________________________________________________________ APPLICANT CONTENDS THAT: The original MSM 2OLC was not posted correctly to his records when the Military Personnel Data System (MILPDS) was updated, and all copies of the original MSM 2OLC documentation were subsequently lost. In support of the request, applicant provides copies of a personal statement, a letter of support, background documentation related to his request, a copy of the original MSM 2OLC Citation, and a reaccomplished MSM 2OLC Citation. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant currently serves on extended active duty in the Regular Air Force in the grade of lieutenant colonel and is stationed at the pentagon. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR states, in part, that without a statement from the approval authority that verifies the MSM 2OLC was approved by their office and also without a special order that verifies the applicant’s entitlement, they must recommend disapproval for award of the MSM 2OLC. The complete DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Due to no fault of his own, his career and promotion opportunity are at serious risk due to an administrative error that he has exhausted all other avenues to attempt correction. He is in the primary zone for the next colonel promotion board, and the competitiveness of his record will be negatively impacted by the absence of this decoration. He requests the Board do the right thing in this case and correct his military record to reflect award of the MSM 2OLC. The applicant’s complete response, with attachments, is at Exhibit E. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice in regards to the applicant’s request for award of the MSM 2OLC. We note the evidence of record reflects that the original MSM 2OLC was approved on 27 Jul 04, was correctly reflected in his records, and subsequently removed. Further, the statement provided by the applicant’s former wing commander, stating that he signed the original MSM 2OLC and the special order, confirms the fact that the applicant was awarded the MSM 2OLC for his contributions to the organization while stationed at Buckley AFB, CO. In our opinion, he has overcome the burden of proof that an error or injustice has occurred, and the reaccomplished MSM 2OLC citation should be added to his records. In view of the above, and in order to resolve any injustice in favor of the applicant, we recommend that his records be corrected to the extent indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating APPLICANT, be corrected to show that he was awarded the Meritorious Service Medal (MSM), Second Oak Leaf Cluster (2OLC), for meritorious service during the period 11 Oct 02 to 22 Jul 04, on 17 Sep 09, and on 17 Sep 09, and the citation was accepted for file in his record. _________________________________________________________________ The following members of the Board considered Docket Number BC- 2010-00097 in Executive Session on 14 Sep 10, under the provisions of AFI 36-2603: --------------, Panel Chair --------------, Member --------------, Member The Board voted to correct the record, as recommended.
