RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-00521 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect the award of the Air Force Overseas Ribbon-Short Tour (AFOR-ST). _________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214, Report of Separation from Active Duty, states he served four months and one day on a temporary duty (TDY) assignment to the Philippines after six service members were assassinated. Many airmen from different bases were sent to augment the security police. In support of the appeal, the applicant provides a copy of his DD Form 214, his Certificate of Accomplishment, and his request for records to the National Personnel Records Center (NPRC). The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Air Force on 10 January 1986 and was progressively promoted to the grade of sergeant (E-4). On 9 January 1990, he was honorably discharged after serving four years of active service. On 12 October 1980, the Chief of Staff, United States Air Force, authorized the AFOR-ST. Before 6 January 1986, the ribbon was awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 September 1980. Normally, the AFOR-ST is awarded for a permanent duty assignment of at least 181 consecutive days or, if stationed overseas, 300 days within an 18 month time span or 548 days in a consecutive 3- year period. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states the applicant was not TDY to the Philippines long enough to receive the short tour credit. The applicant’s records indicate he was TDY to the Philippines for only 2 months and 14 days. He was asked to provide additional information; however, he did not respond. The complete DPAPP evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 4 June 2010, for review and comment within 30 days. As of this date, no response has been received by this office. (Exhibit D) _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
