RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-00566 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His under other than honorable conditions (UOTHC) discharge be upgraded to general. ________________________________________________________________ APPLICANT CONTENDS THAT: His discharge was based on a one-time isolated incident in 48 months of service with no other adverse action. In support of his request, the applicant provides a personal statement. The applicant’s complete submission, with attachment, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 3 Feb 83, the applicant contracted his enlistment in the Regular Air Force. He was progressively promoted to the grade of sergeant having assumed the grade effective and with a date of rank of 19 Jul 85. On 13 Mar 87, the applicant was charged with wrongfully possessing and using methamphetamine on or about 6 Aug 86. The charges were referred on 25 Mar 87. On 18 Mar 87, the applicant through counsel submitted a request for discharge in lieu of trial by court-martial. On 23 Mar 87, his commander recommended the request for discharge be approved and that he be discharged with an UOTHC discharge. Legal reviews were conducted and recommended the request for discharge be approved; and, the applicant receive a UOTHC discharge. On 22 Apr 87, the discharge authority directed a UOTHC discharge. He was discharged on 7 May 87. He served four years, three months and five days of active service. On 17 Jun 10, the Board staff requested the applicant provide documentation concerning his activities since leaving military service. In response to the request for post service documentation the applicant provides a narrative of his activities since leaving the military service and three character references. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. Even though the applicant has provided no evidence to show that his discharge was improper or not in compliance with appropriate directives, it is our opinion that approval on the basis of clemency is warranted in this case. It appears the applicant has led a stable and productive life and it appears there is no evidence that he has had any subsequent involvement of a derogatory nature since his separation from the Air Force. In light of the above, we believe that it would be an injustice for him to continue to suffer the adverse effects of a UOTHC discharge. Therefore we believe an upgrade of his discharge to general (under honorable conditions) is warranted. Accordingly the Board recommends that his records be corrected as indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that on 7 May 1987, he was discharged with service characterized as general (under honorable conditions). _________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2010-00566 in Executive Session on 13 Jul 10 under the provisions of AFI 36-2603: All members voted to correct the record as recommended.
