RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-00754 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect his entitlement to the Air Force Outstanding Unit Award with Valor device (AFOUA, w/V) and the Republic of Vietnam Gallantry Cross, with Palm (RVNGC, w/Palm (administratively corrected by AFPC). ________________________________________________________________ APPLICANT CONTENDS THAT: He is entitled to the AFOUA, w/V, since he was assigned to the 631st Combat Support Group from September 1966 to August 1967. In support of the appeal, the applicant submits a copy of his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, issued in conjunction with his 2 August 1969 release from active duty. Applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a former Regular Air Force enlisted member, who served on active duty from 3 August 1964 until his release from active duty on 2 August 1969. Although an Airman Performance Report, rendered for the period 17 May 1966 through 16 May 1967, reflects his unit of assignment as the 631st Support Squadron, the Air Force Commendation Medal awarded for his assignment with the 631st Support Squadron, reflects meritorious service during the period from 26 September 1966 to 25 September 1967. By letter, dated 26 March 2010, the applicant was advised that his records confirmed his entitlement to the RVNGC, w/Palm, and that his records were administratively corrected. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial and states, in part, that although the applicant’s unit of assignment shared in the award of the AFOUA, w/V, for the period 8 July 1965 to 30 June 1966, with the parent organization; there is no evidence the applicant was assigned to the unit until September 1966, rendering him ineligible. The AFOUA is awarded by the Secretary of the Air Force to units that have distinguished themselves by exceptionally meritorious service or outstanding achievement that clearly sets the unit above and apart from similar units. When the AFOUA is awarded to a unit for combat or direct combat support, the Valor device may be worn on the service ribbon. The complete AFPC/DDPSIDR evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: He requests the Board consider the fact that according to AFP 900-2, the 631st Support Squadron was awarded the AFOUA, w/V, for the period 8 July 1965 through 30 June 1966, per special order GB 351-66. The applicant’s complete response is at Exhibit E. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
