RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-01844 COUNSEL: NO HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Report of Separation from Active Duty, be corrected to reflect his overseas service. Examiner’s Note: Per a telephone communication on 23 June 2010, between the applicant and the Air Force office of primary responsibility (OPR), the applicant specifically requests his service in Greenland and Vietnam be corrected in his record. He asserts he was stationed in Vietnam; however, he does not remember the dates. The AFBCMR staff verified with the OPR that the applicant’s record will be corrected to reflect the applicant’s service in Greenland, after Board consideration on his request for Vietnam service. _________________________________________________________________ APPLICANT CONTENDS THAT: He would like to join the Veterans of Foreign Wars (VFW); however, his DD Form 214 does not show his overseas service. In support of his appeal, the applicant provides copies of his DD Form 214 and two Temporary Duty (TDY) orders. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Regular Air Force who served on active duty from 4 January 1971 through 12 December 1974. He was progressively promoted to the grade of sergeant (E- 4) with a date of rank of 1 October 1972. The applicant served 3 years, 11 months, and 9 days on active duty. His DD Form 214 does not reflect any foreign service. On 3 September 2010, AFPC/DPAPP notified the applicant that they were able to verify his service at Thule Air Base, Greenland, from 1 August 1972 to 31 July 1973 and will correct his record once the Board has made their final determination on his request. However, they were unable to locate any official documentation to verify his service in Vietnam. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial of the applicant’s request to correct his records to reflect service in Vietnam. DPAPP states after a review of the applicant’s master personnel records and the documentation submitted, they found no evidence that he served in the Republic of Vietnam. The complete DPAPP evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 22 October 2010 for review and response within 30 days (Exhibit D). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We note that AFPC/DPAP verified the applicant’s service in Thule, Greenland, and will correct the applicant’s record after Board action. After a thorough review of the applicant’s submission and the evidence of record, we find insufficient evidence of any other overseas service including Vietnam. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice in regard to overseas service in Vietnam.
