RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02165 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His narrative reason for separation of “Personality Disorder” be changed to reflect “Disability.” _________________________________________________________________ APPLICANT CONTENDS THAT: The Department of Veterans Affairs (DVA) found him disabled and he believes the Air Force would have come to the same decision had he been examined prior to discharge. In support of his request, the applicant provides a copy of his DVA rating decision. The applicant's complete submission, with attachment, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 24 Nov 08, the applicant entered the Regular Air Force. On 18 May 09, the applicant was diagnosed with having an Adjustment Disorder with Anxiety and Depressed Mood and Severe Occupational Problems. The psychologist indicated the applicant’s symptoms and condition were not adaptable to short- term treatment and were likely to be exacerbated with further military service. Therefore, he recommended an administrative separation for the applicant. On 10 Jun 09, the applicant was notified of pending discharge action. Specifically, the commander cited the applicant’s diagnosis of Adjustment Disorder as the basis for discharge. The applicant consulted counsel and waived his right to submit statements in his own behalf. The staff judge advocate found the case legally sufficient and recommended discharge. On 22 Jun 09, the discharge authority directed discharge without probation and rehabilitation. On 26 Jun 09, the applicant was honorably discharged with a narrative reason for separation of Personality Disorder and separation code of JFY, and reentry code of 2C, which denotes involuntarily separated with an honorable discharge or entry level separation without characterization of service. He was credited with seven months and three days of active service. _________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPSOS recommends the applicant’s narrative reason for discharge be changed to reflect “Adjustment Disorder.” DPSOS stateS the applicant’s DD Form 214 is in error and his narrative reason for separation should have been reflected as “Adjustment Disorder;” however, this does not infer his separation from the Air Force was unjust or improper. The complete HQ AFPC/DPSOS evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Dec 10 for review and comment within 30 days (Exhibit D). As of this date, this office has not received a response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We note that at the time of his discharge, the applicant’s narrative reason for separation was erroneously labeled Personality Disorder. Accordingly, we conclude it would be unfair and an injustice for him to continue to suffer the adverse effects of the characterization of Personality Disorder. Further, we note the mere presence of a medical condition does not automatically qualify for a disability separation or retirement and the applicant’s condition was unsuitable, rather than unfitting for continued service. Therefore, in view of the above and absent evidence to the contrary, we concur with the office of primary responsibility and adopt their rational as the basis for our decision and recommend his records be corrected as indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that on 26 June 2009, he was discharged by reason of "Adjustment Disorder." _________________________________________________________________ The following members of the Board considered Docket Number BC- 2010-02165 in Executive Session on 24 February 2011, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
