RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02229 COUNSEL: NONE HEARING DESIRED: NO ___________________________________________________________________ APPLICANT REQUESTS THAT: 1. He be awarded the Air Medal (AM). 2. He be awarded the Vietnam Service Medal (VSM) – administratively corrected. ___________________________________________________________________ APPLICANT CONTENDS THAT: He was stationed at Clark Air Base, Philippines, from Jul 69 thru Oct 71 and flew air missions on a C-141 as a medical technician for more than 3 years. He received hazardous duty pay and tax free exemptions while on temporary duty to Vietnam. He is trying to join the Veterans of Foreign Wars (VFW); however, his foreign service is not reflected on his DD Form 214, Certificate of Release or Discharge from Active Duty. In support of his request, the applicant provides a copy of his discharge certificate. His complete submission, with attachment, is at Exhibit A. ___________________________________________________________________ STATEMENT OF FACTS: The relevant facts pertaining to this application, extracted from the applicant’s military records, are contained in the letter prepared by the appropriate office of the Air Force. Accordingly, there is no need to recite these facts in this Record of Proceedings. The AM criteria: It is awarded to U.S. military and civilian personnel for single acts of heroism or meritorious achievements while participating in aerial flight and foreign military personnel in actual combat in support of operations. Required achievement is less than that required for the Distinguished Flying Cross, but must be accomplished with distinction above and beyond that expected of professional airmen. ___________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial. DPSIDR states that after reviewing the applicant’s military personnel record, they were able to verify his entitlement to the Air Force Outstanding Unit Award w/1OLC; the VSM with one Bronze Service Star; and the Republic of Vietnam Gallantry Cross with Palm. DPSIDR will administrative correct his records. However, they were unable to locate a special order or any other official documentation to justify award of the AM. Therefore, DPSIDR cannot support his request for the AM. The DPSIDR complete evaluation is at Exhibit C. ___________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 29 Oct 10 for review and comment within 30 days. As of this date, this office has received no response. ___________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice with regard to the applicant’s request for the AM. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted.
