RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02337 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His general under other than honorable conditions (UOTHC) discharge be upgraded to a general (under honorable conditions) or a medical discharge. _________________________________________________________________ APPLICANT CONTENDS THAT: The Department of Veteran Affairs (DVA) determined he was suffering from anxiety disorder at the time of his discharge. In support of his appeal, the applicant provides a personal statement and DVA documentation. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Regular Air Force who entered active duty on 19 October 2004 and was promoted to the grade of airman first class (E-3). The applicant received one Letter of Counseling, four Letters of Reprimand, and one Article 15 between 27 October 2005 and 19 March 2007. On 21 May 2007, the applicant was notified that his commander was recommending him for a general (under honorable conditions) discharge for Misconduct: Pattern of Misconduct, Conduct Prejudicial to Good Order and Discipline under the authority of Air Force Program Directive 36-32 and Air Force Instruction 3208, paragraph 5.50.2. The applicant acknowledged receipt of the notification, consulted counsel, and submitted statements in his own behalf. On 6 June 2007, the Staff Judge Advocate found the case to be legally sufficient and recommended the applicant be separated with a general (under honorable conditions) discharge without probation and rehabilitation. On 6 June 2007, the discharge authority approved the recommended discharge and directed the applicant be discharged with a general (under honorable conditions) discharge. On 8 June 2007, the applicant was released from active duty after serving 3 years, 5 months, and 19 days on active duty. On 10 March 2010, the Discharge Review Board (DRB) considered and denied the applicant’s request to upgrade his characterization of discharge to honorable. On 8 October 2010, SAF/MRBR, notified the applicant that attempts to obtain his service medical records were unsuccessful and requested his assistance in obtaining them. To date, the applicant has not responded. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error. We note the evidence of record indicates the discharge authority directed the applicant receive a general (under honorable conditions) discharge; however, Block 24 of the applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty, reflects a “General (Under Other Than Honorable)” discharge. We believe this entry to be in error. While the applicant has not provided sufficient evidence to warrant our granting his alternate request of a medical discharge, we believe his DD Form 214 should be corrected to reflect the characterization of service directed by the discharge authority, general (under honorable conditions). Therefore, we recommend his record be corrected as indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that on 8 June 2007, he was discharged with service characterized as general (under honorable conditions). _________________________________________________________________ The following members of the Board considered this application in Executive Session on 24 March 2011, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
