RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02391 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: He receive Special Selection Board (SSB) consideration by the Calendar Year 2009C (CY09C) Major Central Selection Board (CSB), with the inclusion of his Officer Performance Report (OPR) rendered for the period of 29 September 2008 through 27 October 2009, in his Officer Selection Record (OSR). _________________________________________________________________ APPLICANT CONTENDS THAT: The OPR closing out 27 October 2009 was not signed and made a matter of record until 7 December 2009. The wing commander intended for the OPR to be considered by the CY09C CSB; however, an administrative error delayed its completion. In accordance with (IAW) AFI 36-2501, Officer Promotions and Selective Continuation, the CY09C board did not consider information that should have been available which directly affected his promotion opportunity. In support of his request, the applicant provides a copy of his OPR and letters of support from his leadership chain. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of captain. The applicant was considered and not selected by the CY09C CSB to the grade of major. The Evaluation Reports Appeal Board reviewed the application and determined no action was required. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID defers to AFPC/DPSOO. DPSID states the report was processed IAW AFI 36-2406, Officer and Enlisted Evaluation Systems, which states performance reports are due to AFPC no later than 60 days after the closeout date. The closeout of the report was 27 October 2009; therefore, the report was not required to be in the applicant’s OSR until 27 December 2009. Although it may have been the intent of the applicant’s evaluators to have the report processed and made a matter of record prior to the CSB, it was processed IAW AFI 36-2406. The complete DPSID evaluation is at Exhibit C. AFPC/DPSOO recommends denial. DPSOO states the absence of the 27 October 2009 OPR does not constitute an error since it was not required to be filed in his OSR for the CY09C CSB until 27 December 2009. If the applicant believed this document was important in his promotion consideration, he could have written a letter to the board members informing them of the accomplishments mentioned in the reports. DPPPO has verified the applicant did not exercise this entitlement. The complete DPSOO evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluation were forwarded to the applicant on 22 October 2010, for review and comment within 30 days. However, as of this date, no response has been received by this office. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After reviewing the evidence of record, we are not persuaded the applicant’s records are erroneous or unjust. The applicant’s contentions are noted; however, in our opinion, the detailed comments provided by the appropriate Air Force offices of primary responsibility have adequately address those allegations. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
