RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-03270 COUNSEL: NONE HEARING DESIRED: NOT INDICATED _________________________________________________________________ APPLICANT REQUESTS THAT: He be awarded the Air Force Commendation Medal (AFCM) for time served in Thailand (16 May 1969 through 15 May 1970) and supplemental promotion consideration to Master Sergeant (MSgt), Senior Master Sergeant (SMSgt), and Chief Master Sergeant (CMSgt). ________________________________________________________________ APPLICANT CONTENDS THAT: He should have received the AFCM for his accomplishments in Thailand. During the contested time frame he missed promotion to MSgt by 3 points. He believes he would have been promoted earlier to the rank of MSgt, and would have possibly been promoted to SMSgt and CMSgt. In support of his request, the applicant provides a personal statement and a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: AFPC/DPSIDRA was able to verify the applicant’s entitlement to the AFCM for meritorious service at March Air Force Base, California, from 23 June 1970 to 15 September 1971 per Special Order G-145. His records will be administratively corrected. The remaining relevant facts pertaining to this application are contained in the letters prepared by the appropriate offices of the Air Force. Accordingly, there is no need to recite these facts in this Record of Proceedings. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDRA recommends denial. DPSIDRA states the applicant has not provided a signed recommendation from someone within his chain of command who possesses firsthand knowledge of the act or achievement, a proposed citation, chain of command endorsements, or eyewitness statement(s). The complete DPSIDRA evaluation, with attachment, is at Exhibit C. AFPC/DPSOE recommends denial. DPSOE states the applicant’s record contains one promotion order to the grade of MSgt. Promotion files are maintained for 10 years, his rank to technical sergeant cannot be determined. Without this information, there is no way of knowing when he was eligible for promotion consideration to MSgt, which decorations were considered in the promotion process, and whether the addition of the AFCM would render him a select during an earlier promotion cycle. The complete DPSOE evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 17 December 2010, copies of the Air Force evaluations were forwarded to applicant for review and comment within 30 days. To date, a response has not been received (Exhibit E). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. The applicant’s contentions are duly noted; however, after reviewing the evidence of record we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
