His records be updated to reflect his Aircraft Maintenance Technician Course AMF 43171C (F-100) – administratively corrected. 2. He be credited with one year of foreign service for serving in Vietnam – administratively corrected. 3. He be awarded the Small Arms Expert Marksmanship Ribbon (SAEMR). 4. He be awarded unit citations and any missing Vietnam entitlements – administratively corrected to reflect he was awarded the Presidential Unit Citation (PUC); Air Force Training Ribbon (AFTR), and the Republic of Vietnam Gallantry Cross with Palm (RVGC w/P). _________________________________________________________________ APPLICANT CONTENDS THAT: His entitlement to the requested corrections can be verified by reviewing his official military personnel file. In support of his request, the applicant provides a copy of his Certificate of Training, a copy of his DD Form 214, Armed Forces of the United States, Report of Transfer or Discharge, and a copy of his AF Forms 899, Permanent Change of Station Order – Military. His complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted into the Regular Air Force on 30 Aug 65 and was progressively promoted to the grade of staff sergeant (E- 5), having assumed that grade effective and with a date of rank of 1 Jan 69. He received an honorable discharge on 22 Jan 69 after serving 3 years, 4 months, and 23 days on active duty. AFPC/DPSIDR verified the applicant’s entitlement to the PUC, RVNGC w/P, and the AFTR. SAF/MRBR notified the applicant that his DD Form 214 will be corrected to reflect Vietnam as Yes and his foreign service will be updated accordingly. SAEMR criterion: The SAEMR was authorized by the Secretary of the Air Force on 28 Aug 62. It is awarded to all U.S. Air Force service members who, after 1 Jan 63, qualify as expert in small- arms marksmanship with either the M-16 or issue handgun. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial of the SAEMR. DPSIDR states they were unable to verify the applicant’s entitlement to the SAEMR due to the lack of official documentation in his official military records. The DPSIDR complete evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 25 Feb 11 for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice with regard to the applicant’s request for the SAEMR; unit citations and other Vietnam service entitlements. However, although the applicant did not ask forspecific awards in his request, his record has been administratively corrected to reflect award of the Presidential Unit Citation (PUC); Air Force Training Ribbon (AFTR), and the Republic of Vietnam Gallantry Cross with Palm (RVGC w/P). We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted.
