RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-04007 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ THE APPLICANT REQUESTS THAT: He be promoted to the rank of lieutenant colonel. ________________________________________________________________ THE APPLICANT CONTENDS THAT: His promotion to lieutenant colonel, as verified by his former medical service flight commander, never caught up with him; however, he did in fact promote him. He enlisted in the Missouri Air National Guard (MOANG) and served for over 33 years as a pharmacist. In support of his appeal, the applicant provides a personal statement; a copy of a letter from his former commander, and a chronological record of service. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: Based on the available records, the applicant was considered for promotion by the Fiscal Year 1973 (FY73) Lieutenant Colonel Promotion Board, which convened on 24 Apr 72. He was notified of his non-selection and pending consideration by the next promotion board. He was subsequently considered by the FY74 Lieutenant Colonel Promotion Board, which convened on 9 Apr 73. He received a letter notifying him of his second non-selection and his pending discharge. His discharge order was effective 31 Dec 73. ________________________________________________________________ THE AIR FORCE EVALUATION: ARPC/DPB recommends denial, stating, in part, the applicant met and was non-selected by two promotion boards. No evidence exists to indicate the applicant was promoted above the grade of major. The complete ARPC/DPB evaluation, with attachments, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: The applicant reiterates his original contentions that his former commander recommended his promotion prior to his discharge. In support of his response, he provides a personal statement and a copy of one of his Officer Effectiveness Report (OER). The applicant’s complete response, with attachments, is at Exhibit E. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force Reserve office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. In our view the evidence of record and the documentation submitted by the applicant is insufficient to substantiate the applicant’s claim that he was recommended for and promoted to the grade of lieutenant colonel.
