ADDENDUM TO RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-00249 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: Her Reentry (RE) code of 2C (involuntarily separated with an honorable discharge; or entry level separation without characterization of service) be upgraded. ________________________________________________________________ STATEMENT OF FACTS: A similar appeal was considered and denied by the Board on 16 August 2011. For an accounting of the facts and circumstances surrounding the applicant’s separation, and, the rationale of the earlier decision by the Board, see the Record of Proceedings at Exhibit F. The applicant submits a request for reconsideration, contending that her RE code was based on the recently repealed Don’t Ask Don’t Tell (DADT) category. She desires to recommit herself to the military and would like to apply to the Air National Guard. This is her second request, for the first request was denied just prior to the repeal of DADT. The applicant’s complete submission is at Exhibit G. ________________________________________________________________ THE BOARD CONCLUDES THAT: In an earlier finding, prior to the repeal of DADT, the Board determined there was insufficient evidence to warrant corrective action. We have reviewed the applicant’s statements indicating the Board’s determination that subsequent to the repeal of DADT she should resubmit her request. Based on the repeal of DADT, the Department of Defense issued policy guidance that Service Discharge Review Boards should normally grant requests to re- characterize the discharge to honorable, when both of the following conditions are met: (1) the original discharge was based solely on DADT or a similar policy in place prior to enactment of DADT and (2) there were no aggravating factors in the record, such as misconduct. Based on our review of the evidence of record, the applicant’s discharge meets these requirements. Therefore, we recommend her records be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to reflect that on 3 Feb 94, she was discharged under the provisions of AFR 39-10, with a reason for separation of Secretarial Authority, with the corresponding separation code of KFF, and a reentry (RE) code of 1J. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-00249 in Executive Session on 9 Apr 13, under the provisions of AFI 36-2603: The following documentary evidence was considered: Exhibit F.
