RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-00872 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His separation code and narrative reason be changed to a hardship separation. _________________________________________________________________ APPLICANT CONTENDS THAT: He was never diagnosed with any form of personality disorder. His wife was having severe problems that made his time in the military impossible. He was not given any choice in the matter of his discharge codes nor were the codes ever explained to him. If he had known what the codes meant he would not have allowed the discharge to be finalized. He loves the Air Force, but he believes that it is not appropriate to be labeled this way because it is not a true depiction of him. He has been applying for employment; however, he has been turned down due to his separation code and narrative reason for separation. He states that the Air Force does not have any proof or reason for the separation code that was given. In support of his request, the applicant provides a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted into the Regular Air Force on 14 Nov 00. His commander notified the applicant that he was recommending him for discharge from the Air Force for a mental disorder, as diagnosed by the Diagnotic and Statistical Manual of Mental Disorders (DSM-IV). The evaluation stated the applicant’s ability to function in a military environment is considered significantly impaired. The applicant acknowledged receipt of the notification of discharge and was advised of his right to consult with legal counsel and submit statements in his own behalf. After a legal review, the base legal office found the case legally sufficient. The discharge authority approved the separation and directed the applicant be discharged with an uncharacterized entry-level separation. His DD Form 214, Certificate of Release or Discharge from Active Duty, reflects he received a separation code of “JFX” (Personality Disorder) and a narrative reason for separation of “Personality Disorder”. The applicant was discharged on 6 Mar 01 after serving 3 months and 23 days on active duty. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOS recommends changing the applicant’s SPD code of “JFX” to “KFF” (Secretarial Authority) since the current SPD code does not accurately reflect his diagnosis of a “Mental Disorder (Other)”. DPSOS notes that Services characterized all separatees discharged due to a mental disorder under a blanket Separation Program Designator (SPD) Code of “JFX” with a narrative reason of “Personality Disorder”. However, the Services met with the Office of the Secretary of Defense (OSD) and requested the establishment of additional, more specific SPD identifiers to more clearly designate the specific type of mental disorders. DPSOS also recommends the applicant’s narrative reason for separation be corrected to reflect “Secretarial Authority”. DPSOS does not recommend a change in the applicant’s reentry code. The DPSOS complete evaluation is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Jun 11 for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice with regard to changing the applicant’s SPD code and narrative reason for separation. In this respect, we note that since the SPD code he received did not accurately reflect the applicant’s diagnosis of a “Mental Disorder (Other)”, we agree with the Air Force office of primary responsibility that his SPD code should be changed to “KFF” and his narrative reason for separation be corrected to reflect “Secretarial Authority”. However, AFPC/DPSOS does not recommend changing the applicant’s RE code. Consequently, we recommend that the records be corrected as indicated below. ______________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that on 6 March 2001, he was discharged under the provisions of AFR 39-10 (or AFI 36- 3208), paragraph 1-2, (Secretarial Authority) with Separation Program Designator (SPD) Code of KFF. ______________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-00872 in Executive Session on 19 Jul 11, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records, as recommended.
