He served in Vietnam. 2. He served in Air Force Specialty Code (AFSC) “55151 - Heavy Equipment Operator,” rather than “55150 – Pavement Maintenance Specialist.” _________________________________________________________________ APPLICANT CONTENDS THAT: The AF Forms 899, Request and Authorization for Permanent Change of Station – Military, show that he was a part of the 377 Combat Support Group, Pacific Air Forces (PACAF). His records do not show that he was a noncommissioned officer in charge (NOCIC) or a Heavy Equipment Operator - AFSC (55151). In support of his request, the applicant provides a personal statement and copies of his permanent change of station (PCS) orders. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant served on active duty in the Regular Air Force from 13 Jun 68 to 19 Jan 72. His DD Form 214 reflects a total of 1 year, 2 months, and 18 days of Foreign Service. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial of the applicant’s request to correct his record to reflect he served in Vietnam. DPAPP states a review of the applicant’s master personnel records and the documentation provided failed to substantiate Foreign Service in Vietnam. DPAPP was able to verify boots on the ground at Ching Chuan Kang Air Base, Taiwan, from 31 Oct 70 to 17 Jan 72, for 1 year, 2 months, and 18 days, which is reflected on his DD Form 214. The complete DPAPP evaluation is at Exhibit C. AFPC/DPSIDC recommends denial of the applicant’s request to change his Air Force Specialty Code and Title on his DD Form 214. DPSIDC states neither the information provided nor his official records indicate the applicant ever served in AFSC 55151. Special Order AE-517, dated 17 Jul 68, and the performance reports available in the applicant’s record, indicate he performed duty in AFSC 55150, Pavement Maintenance Specialist, from Jul 68 until Mar 71, the close out of the last available performance report. The complete DPSIDC evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 18 Nov 11, copies of the Air Force evaluations were forwarded to the applicant for review and comment within 30 days. To date, a response has not been received (Exhibit E). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved.
