RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-02669 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: He be awarded the Air Force Good Conduct Medal (AFGCM). _________________________________________________________________ APPLICANT CONTENDS THAT: He served in the Air Force honorably for four years and he believes he is entitled to the AFGCM. His only infraction was a speeding ticket he received while responding to an emergency which was related to his military duty. In support of his request, the applicant submits a copy of his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge. The applicant's complete submission, with attachment, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 30 January 1961. On 29 October 1965, the applicant was honorably released from active duty and transferred to the Air Force Reserve. He served 4 years and 9 months on active duty. Authorized 1 June 1963, the AFGCM is awarded to enlisted service members of the U.S. Air Force for exemplary conduct during a continuous three year period of military service while in the active military service of the United States. Service members awarded this medal must have had character and efficiency ratings of excellent or higher throughout the qualifying period including time spent in attendance at service schools, and there must have been no convictions of court martial during this period. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDRA recommends denial. DPSIDRA notes the applicant’s Form 7 states “service from 17 November 1961 through 24 January 1964 not creditable for award of GCM.” Due to this remark, he is ineligible for the AFGCM as he did not complete three continuous years of honorable active duty service. The DPSIDRA complete evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states he received a speeding ticket in route to responding to a trouble call at one of the sites on base. He received no other written documentation concerning this incident. He believes he is entitled to the AFGCM. The applicant’s complete response is at Exhibit E. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and the recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has failed to sustain his burden of proof of the existence of an error or injustice.
