RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-02672 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, reflect the Air Force Commendation Medal (AFCM). _________________________________________________________________ APPLICANT CONTENDS THAT: Award of the AFCM is not annotated on his DD Form 214. In support of his request, the applicant submits a copy of the certificate and citation for award of the AFCM and a copy of his DD Form 214. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 3 August 1989. On 27 November 1992, the applicant was honorably released and transferred to the Air Force Reserve. He served 3 years, 3 months, and 25 days on active duty. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDRA recommends denial. DPSIDRA states a special order authorizing entitlement to the AFCM was not provided by the applicant nor located within his official military record. On 2 September 2011, DPSIDRA contacted the applicant requesting he provide a copy of the special order authorizing his entitlement to the AFCM. On 3 September 2011 the applicant responded stating he did not possess a copy of the special order. DPSIDRA notes several inconsistencies with the elements the applicant has provided that lead them to question if the documentation was actually approved. The provided citation is not written in-line with Air Force standards as the words “he” and “his” are consistently used throughout the provided citation instead of the standard “Airman O’---.” The provided certificate shows an inclusive period of 2 September 1991 to 1 December 1992; however, according to the applicant’s provided DD Form 214 he was released from active duty on 27 November 1992. The “given under my hand” date is 4 October 1994, nearly two years after the applicant was released from active duty. Also noted is the Department of the Air Force seal on the certificate is barely legible but the rest of the document is in bold clear print. The applicant also states the date of discovery to have been 1 December 1992; however, with a given under my hand date of October 1994 the applicant could not have received the decoration elements prior to them being signed in October 1994. The DPSIDR complete evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 23 September 2011, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant’s contentions are duly noted; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
