RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-03259 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ THE APPLICANT REQUESTS THAT: He be awarded the Presidential Unit Citation (PUC). ________________________________________________________________ THE APPLICANT CONTENDS THAT: He is eligible based on his record of service. The applicant’s complete submission is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: Based on the available record, the applicant was discharged effective 13 Dec 45. He was credited with 1 year, 1 month, and 18 days of continental service and 1 year, 9 months, and 13 days of foreign service. He completed combat missions and participated in the Air Offensive Europe, Northern France, Normandy, Central Europe and the Rhineland campaigns. ________________________________________________________________ THE AIR FORCE EVALUATION: AFPC/DPSIDRA recommends denial, stating, in part, that they were unable to confirm what unit the applicant served with while in England or if he served with a unit that was awarded the PUC while he was assigned. The complete AFPC/DPSIDRA evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: The applicant provided copies of post-marked envelopes which are the only evidence of locations and time periods he served during the war (Exhibit E). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting corrective action. We took notice of the applicant’s complete submission, in judging the merits of the case. We note the comments of the Air Force offices of primary responsibility; nonetheless, in his response to the advisory opinion, the applicant provided additional documentation to substantiate his claim. While the documents are not conclusive evidence the applicant was assigned to the units at the time, we find that this provides creditable evidence that is consistent with his statements and his foreign service in WWII. Therefore, in our view, we believe that any doubt should be resolved in his favor. In view of the above, we recommend the applicant be awarded the PUC. Accordingly, we recommend the applicant’s record be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that his WG AGO Form 53-55, Enlisted Record and Report of Separation, issued 13 December 1945, Item 33, Decorations and Citations be amended to reflect award of the Presidential Unit Citation. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-03259 in Executive Session on 22 May 2012, under the provisions of AFI 36-2603: All members voted to correct the records as recommended.
