RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-03355 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect award of the Combat Action Badge (CAB). _________________________________________________________________ APPLICANT CONTENDS THAT: He should receive the CAB because he was stationed at Da Nang Airfield on 27 Feb 67 when it was under attack by the Viet Cong. In support of his request, the applicant provides copies of documents extracted from his military personnel records, an article, and photographs. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 30 Nov 62, the applicant entered active duty in the Regular Air Force. He served as an Jet Aircraft Mechanic. On 7 Mar 67, he was honorably discharged and was credited with four years, three months, and eight days of active service. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibit C. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIMC recommends denial noting the Air Force is not authorized permanent wear of the CAB. The CAB may be awarded by any commander delegated authority by the Secretary of the Army during wartime, the CG, or US Army Human Resources Command and will be announced in permanent orders. The governing instruction AFI 36-2903, Dress and Personal Appearance of Air Force Personnel, outlines the wear of sister-Service badges, insignias or patches and does not authorize permanent wear of the CAB. The CAB is only worn while permanently assigned to and performing duties with other services when awarded; upon permanent change of stations to an Air Force unit the member will remove it. The complete AFPC/DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 13 Dec 11, for review and comment within 30 days. As of this date, no response has been received by this office. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and the recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Therefore, while we are not unmindful or unappreciative of the applicant’s service to the Nation, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. _________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. _________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-03355 in Executive Session on 12 Apr 12, under the provisions of AFI 36-2603: The following documentary evidence was considered: Exhibit A.
