RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-03581 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: He be entitled to medical continuation (MEDCON) on active duty from 13 Jun – 29 Jul 11. ________________________________________________________________ APPLICANT CONTENDS THAT: He was unjustly released from active duty on 12 Jun 11, because his medical profile changes were not timely processed. He should have remained on active duty until 29 Jul 11. In support of his appeal, the applicant provides copies of AF Forms 469, Duty Limiting Condition Report, dated 28 Mar 11 and 28 Jun 11, AF Form 422, Notification or Air Force Member’s Qualification Status, dated 2 Aug 11. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant was on a medical continuation order for the period 19 Nov 10 – 12 Jun 11. On 28 Jun 11, his medical provider recommended he be medically continued on active duty until 2 Aug 11. On 2 Aug 11, the applicant’s AF Form 422, reflects he was “Returned to duty with waiver expiring 31 Jul 14.” ________________________________________________________________ THE AIR FORCE EVALUATION: NGB/A1PS concurs with the subject matter expert’s (SME) recommendation for partial relief. Based on the evaluation by the SME, they noted that the Air Force Medical Operations Agency (AFMOA/SGHI) declined MEDCON for this period as the applicant's profile had expired and his servicing Wing did not provide updated documentation in the MEDCON request. AFMOA stated in its 11 Aug 11 email to the NGB/SG that the applicant is "possibly entitled to MEDCON for the period 28 June 11 to 2 Aug 11 but will have to process his request through the BCMR program," based on the available documentation. The complete NGB/A1PS evaluation, with attachments, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Sep 11 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting partial corrective action. The Air Force office of primary responsibility has adequately addressed the issues presented by the applicant and we are in agreement with their opinion and recommendation. In addition, while we note the applicant believes his orders should have started on 13 Jun 11 rather than 28 Jun 11, there is no documentation to show he was unable to perform his military duties following his initial release from active duty, until he was placed in a duty limiting status (AF Form 469) on 28 Jun 11. Accordingly, we agree with the opinion and recommendation of the NGB OPR that the applicant should have been placed on medical continuation orders from 28 Jun 11 to 2 Aug 11, the date it was determined the applicant should be returned to duty. Therefore, we recommend his record be corrected to the extent indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that he was placed on extended active duty for the period 28 June 2011 until his release from active duty on 2 August 2011. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-03581 in Executive Session on 31 May 2012, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
