RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-04058 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His Active Duty Service Commitment (ADSC) be reaccomplished to reflect an initial application date of 12 November 2009 instead of the current date of 27 April 2011. _________________________________________________________________ APPLICANT CONTENDS THAT: He initially applied for TEB on 12 November 2009; however, he realized the transfer was never completed on 26 April 2011. Therefore, he quickly reaccomplished the transfer on 27 April 2011. When he initially enrolled on the official website for TEB everything seemed complete. There was no indication there was any additional steps required for completion of the process. In support of his appeal, the applicant provides copies of his permanent change of station (PCS) orders, training allocation notification, In-processing checklist, TEB discussion thread (2011), and a Department of Veteran Affairs (DVA) confirmation of TEB election, dated 28 May 2009. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of lieutenant colonel (O-5). The remaining relevant facts, extracted from the applicant’s military service records, are reflected in the evaluation by the Air Force office of primary responsibility at Exhibit B. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIT recommends denial. DPSIT states that the AFPC Service Center received the applicant’s initial TEB application request on 16 November 2009. However, in order to complete the request he had to complete the Statement of understanding (SOU). The applicant failed to complete the SOU and his application for TEB expired on 7 January 2010. He did not reapply for TEB until 27 April 2011, at which time his request was approved. The complete AFPC/DPSIT evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 10 November 2011, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit C). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
