His Primary Specialty reflecting his RECCE/SURV/ELECT WARFARE PILOT experience in Block 11 of his DD Form 214, Certificate of Release or Discharge from Active Duty, be changed to read “K11R3A,” instead of “11R3A.” (Request later withdrawn.) 2. Change his Duty Air Force Specialty Code (DAFSC) in Block 4 of his Officer Performance Reports (OPR) closing on 15 Dec 01 and 22 Aug 02, to read “K11R3A,” instead of “11R3A.” 3. By amendment, change his Duty Titles on the contested OPRs by adding “IP, E-3” to the end of the existing Duty Title. 4. Change the “From” date in Block 5, Period of Report, on his OPR closing on 22 Aug 02, to read “16 Dec 01,” instead of “15 Dec 01.” ________________________________________________________________ APPLICANT CONTENDS THAT: He completed instructor upgrade training in Sep 01, and maintained that rating until he had a Permanent Change of Station (PCS) in the summer of 2002. He was an instructor pilot for over a year, but with the incorrect information on his OPRs, that fact cannot be displayed on his DD 214. This is an injustice because it keeps the fact that he was an E-3 instructor pilot for a year off of his DD 214 and could affect his chances at competing for future employment opportunities. In support of his request, the applicant provides copies of his DD Form 214, the contested OPRs, and an Individual Flight Record Report. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant entered active duty on 29 May 91, and served until his retirement on 1 Nov 11. He was credited with 20 years, 5 months, and 2 days of active service. On 8 May 12, he acknowledged his total time as a RECCE/SURV/ELECT WARFARE PILOT was less than the one year minimum required to be reflected on his DD Form 214, and withdrew his request concerning changing his DD Form 214. The remaining relevant facts pertaining to this application are contained in the letters prepared by the appropriate offices of the Air Force, which are attached at Exhibits C and D. ________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPAOC3 recommends approval indicating there is evidence of an error or injustice. The member was indeed performing instructor duties during this time period as noted in his substantiating documentation. The member may have been in a position that was not authorized as a “K” prefix (denoting instructor status) within the squadron. The typical approach is to have the member annotated with the “K” prefix on his DAFSC or add “IP, E-3” to the end of his duty title if the position does not match the member’s qualifications. Recommend changing member’s records to show one or both of these changes. The complete AFPC/DPAOC3 evaluation is at Exhibit C. HQ AFPC/DPSID recommends only adding “IP, E3” to the end of his duty title on both of the OPRs in question. This is due to the fact that the DAFSC is correct as noted by AFPC/DPAOC3 as the applicant may not have been in a position authorized a “K” prefix. However, if the applicant was performing these duties, it should be reflected in this Duty Title. The complete AFPC/DPSID evaluation is at Exhibit D. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant affirms his request for both a change of DAFSC and Duty Title on his OPRs. The applicant is not certain how the AFPC/DPSID advisors concluded a “K” prefix should not be added to his DAFSC. He was the Chief of Pilot Training for the AWACS Training Squadron and in charge of the training program for all pilots, including instructor pilots. AFPC/DPAOC3’s recommendation was to change one or both of these. Both changes would include adding the “K” prefix as requested (Exhibit F). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s request to correct his officer performance reports (OPR) to reflect he held the “K11R3A” Duty Air Force Specialty Code (DAFSC). The applicant contends that he served as an instructor pilot during the applicable reporting period and, as such, the contested OPRs should reflect the requested DAFSC. After a thorough review of the evidence of record and the applicant’s complete submission, including his response to the advisory opinions rendered in this case, we believe a preponderance of the evidence indicates the applicant served in a position qualifying for award of the requested DAFSC. In this respect, we note the narrative of the contested OPRs clearly indicates that he performed such duties during the period in question. While we note the comments of AFPC/DPSID indicating that it would be more appropriate to change the applicant’s duty title to include “IP, E-3” as the applicant has not provided proof he served in a qualifying position, we find it highly likely, given the description of the applicant’s duties and accomplishments in the contested OPRs, that he was indeed assigned to such a position. Therefore, we believe the contested OPRs should be corrected to reflect the “K11R3A” DAFSC. While changing his duty title to include “IP, E-3” is among the applicant’s requests, we are not persuaded doing so is appropriate in this case. In this respect, we note the comments of AFPC/DPAOC3 indicating that including “IP, E-3” in the duty title is an appropriate alternative when it cannot be confirmed that a member served in qualifying duty position. However, as the preponderance of the evidence indicates the applicant served in such a position, we believe correcting the DAFSC constitutes full and fitting relief in this case. As for the applicant’s contention the “From” date reflected on his OPR closing on 22 Aug 02 should reflect “16 Dec 01” instead of “15 Dec 01,” we agree. Therefore, we recommend the applicant’s records be corrected to the extent indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that: 1. Block 4, DAFSC, of his Officer Performance Reports (OPR) closing on 15 December 2001 and 22 August 2002 be corrected to reflect “K11R3A,” instead of “11R3A.” 2.
