Joint Service Achievement Medal (JSAM) (Administratively resolved). 2. Meritorious Unit Award (MUA) (Administratively resolved). 3. Air Force Outstanding Unit Award (AFOUA), third bronze oak leaf cluster (3BOLC). ________________________________________________________________ APPLICANT CONTENDS THAT: He researched unit awards and discovered that one of his units was awarded the AFOUA right after he left the unit in Dec 07. Thus, he should have the AFOUA w/3 BOLCs. In support of his request, the applicant submitted copies of his Certificate for the JSAM, his DD Form 214, Certificate of Release or Discharge from Active Duty, a Letter of Evaluation, his SURF, and web-based information pertaining to MUAs and AFOUAs. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: According to the applicant’s military personnel records, he entered the Air Force 24 Sep 02, separated on 31 Aug 10, and was credited with 7 years, 11 months, and 7 days of active service. The Air Force offices of primary responsibility (OPR) reviewed the applicant’s records and administratively corrected the following errors: 1. AFPC/DPSIDR verified his entitlement to the JSAM and MUA. 2. AFPC/DPAPP confirmed he was TDY to Afghanistan from 21 Jan to 19 May 07, served in Japan from 28 Dec 07 to 31 Aug 10, and determined his record should reflect three years and three days of foreign service. 3. AFPC/DPSIDRA verified his entitlement to the Air Force Overseas Ribbon-Long Tour (AFOR-LT). The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial, indicating there is no evidence of an error or injustice concerning his request for the AFOUA (3BOLC). The AFOUA is awarded by the Secretary of the Air Force to numbered units that have distinguished themselves by exceptionally meritorious service or outstanding achievement that clearly sets the unit above and apart from similar units. The services include: performance of exceptionally meritorious service, accomplishment of specific outstanding achievement of national or international significance, combat operations against an enemy of the United States, or military operations involving conflict with or exposure to hostile actions by an opposing foreign service. While the applicant’s entitlement to the AFOUA w/2 BOLCs was verified, there is no documentation in his submission or military records that indicates he should be awarded the AFOUA (3BOLC). He was awarded one AFOUA while serving with each of the two units he was permanently assigned to during his service career. The applicant may be confused by the fact that his parent organization is listed as having earned the AFOUA, however, the applicant served in a subordinate organization which shared in the award per the same order, SO G- 012. Therefore, award of the AFOUA (3BOLC) is not authorized. A complete copy of the AFPC/DPSIDR evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 13 Jan 12 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to award of the AFOUA, third bronze oak leaf cluster (3BOLC). We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the Air Force OPR has determined the applicant is entitled to the Joint Service Achievement Medal (JSAM), Meritorious Unit Award (MUA), Air Force Overseas Ribbon-Long Tour (AFOR-LT), and additional foreign service credit and has corrected his records administratively.
