RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-04759 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: He be awarded the Kosovo Campaign Medal (KCM). ________________________________________________________________ APPLICANT CONTENDS THAT: He was stationed at Shaw AFB with the 79th Fighter Squadron, and was sent to Kosovo for joint operations in May 99. In support of his request, the applicant provides a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant entered active duty on 5 Jun 96, was furnished an Honorable discharge on 4 Jun 00, and was credited with four years of active service. The Kosovo Campaign Medal is authorized to members of the military who took part in or assisted in direct support of one or more of four Kosovo Operations or three Kosovo Task Forces while serving within the following Kosovo Air Campaign or Kosovo Defense Campaign areas of eligibility (AOE) between 24 Mar 99 through 10 Jun 99: the total land area and air space of Serbia (including Kosovo), Montenegro, Albania, Macedonia, Bosnia, Croatia, Hungary, Romania, Greece, Bulgaria, Italy and Slovenia; and the waters and air space of the Adriatic and Ionian Sea north of the 39th North latitude. On 17 Apr 12, AFPC/DPSIDRA notified the applicant that after a thorough review of his official military personnel records, with the assistance of the Directorate of Assignments and Defense Finance and Accounting Service (DFAS), they were unable to verify his entitlement to the KCM. However, they were able to verify his entitlement to the Air Force Outstanding Unit Award (AFOUA) while he was assigned to the 79thFighter Squadron, Shaw AFB, SCand corrected his records administratively. The remaining relevant facts pertaining to this applicationare described in the letterprepared by the Air Force office of primary responsibility which isincluded at Exhibit C. AIR FORCE EVALUATION: AFPC/DPAPPrecommends denial, indicating there is no evidence of an error or injustice. While the applicant’s foreign service in Saudi Arabia and Turkey was verified, athorough review of the applicant’s Master Personnel Records and the information he provided revealed no information that indicates he served inKosovo. A complete copy of the AFPC/DPAPPevaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 27 Apr 12for review and comment within 30 days. As of this date, no response has been received by this office(Exhibit D). THE BOARD CONCLUDES THAT: 1.The applicant has exhausted all remedies provided byexisting law or regulations. 2.The application was not timely filed;however, it is in the interest of justice to excuse the failure to timely file. 3.Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Forceoffice of primary responsibility (OPR) and adopt itsrationale as the basis for our conclusion the applicant has notbeen the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the reliefsought in the application.
