RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-02801 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: 1. Her fitness assessment (FA), dated 8 June 2011, be corrected to show a passing score in the Air Force Fitness Management System (AFFMS). 2. Her referral Enlisted Performance Report (EPR) for the period ending 16 November 2011, be removed from her records. ________________________________________________________________ APPLICANT CONTENDS THAT: 1. On 24 April 2012, she faced a discharge board for four failed fitness assessments. The board decided that she did not fail the FA dated 8 June 2011, due to her being misdiagnosed, and therefore, put on the wrong profile. She was made to complete the cardio component of the FA and had a 74.3 score. Seven months later, she was diagnosed with a medical condition that would have made her exempt from the cardio component of the FA. If she had been on the correct profile when she completed the June 2011 FA, she would have passed the FA with a 75.5 score and would not have received the referral EPR. With the referral EPR removed from her records she will be able to test for promotion for the first time in three years. 2. In support of her request, the applicant submits copies of Administrative Separation Board proceedings, her contested referral EPR, and her Report of Individual Fitness. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Staff Sergeant (SSgt), E-5. ________________________________________________________________ AIR FORCE EVALUATIONS: AFPC/DPSIM recommends granting the relief sought to exempt the cardio component of the FA dated 8 June 2011. DPSIM states that the administrative separation board found the applicant did not fail the contested FA; according to calculations, her score would reflect 75.5 (satisfactory) had she been exempt from the cardio component. The complete AFPC/DPSIM evaluation, with attachments, is at Exhibit C. AFPC/DPSID recommends approval. DPSID states that based on the AFPC/DPSIM advisory to grant the relief sought to exempt the cardio component of the FA dated 8 June 2011, they contend that the fitness assessment failure is an inappropriate comment on the contested referral EPR, and as a result, the referral EPR should be removed from her record. The complete AFPC/DPSID evaluation is at Exhibit D. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS: Copies of the Air Force evaluations were forwarded to the applicant on 25 April 2013 for review and comment within 30 days (Exhibit E). To date, a response has not been received. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice to warrant relief. After a thorough review of the evidence of record and the applicant’s submission we believe relief is warranted. Based on the supporting documentation provided, we find the applicant’s medical condition had a direct impact on her ability to pass the referenced fitness assessment (FA) and therefore agree with the Air Force office of primary responsibility that the cardio portion of the FA dated 8 June 2011, should be corrected to reflect “exempt” in the Air Force Fitness Management System (AFFMS). Since we have favorably considered the correction to the applicant’s FA, the applicant’s contested EPR should be removed. Accordingly, we recommend the records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show: a. The cardio component of the fitness assessments dated 8 June 2011, be amended to reflect “exempt” in the Air Force Fitness Management System (AFFMS). b.
