RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-03846 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His 27 Jun 12 Fitness Assessment (FA) score be removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: His score for the run portion of the FA was incorrectly recorded. His score was 12:19 and not 13:34 as recorded. During the FA in question he ran alongside fellow a airman for four laps and passed him on the fifth lap. Upon crossing the finish line he heard the timekeeper state 12 minutes but could not make out the seconds. The airman indicates the applicant completed the run portion of the FA ahead of his 12:59 run time. Also, the applicant activated the run tracker application on his cell phone within ten seconds of starting the run and the stats reflect he had a run time of 12:11 on 27 Jun 12. He cooled down for a moment after completing his run but noticed another airman struggling to complete their last lap. He again entered the track to provide support to the airman in completing the run by running with the airman and when they crossed the finish line the Fitness Assessment Cell (FAC) personnel incorrectly recorded his time as 13:34. He informed the FAC personnel that his run time was not accurate and requested to see the log sheet. His run time of 12:19 was lined through and replaced with 13:34. He was told the 12:19 was recorded in the wrong place and was corrected with the 13:34. Also, a FAC staff member informed him that they remembered him reentering the track and did not record the time of the second airman as his time. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the rank of technical sergeant (E-6). On 27 Jun 12, the applicant participated in the contested FA attaining a cardio time of 13:34, abdominal circumference measurement of 36 inches, and was exempt from push-up and sit- ups. His overall score was 74.13. The minimum passing score for an FA is 75.00. Under the provisions of AFI 36-2905, Fitness Program, the service member signs the score sheet upon completion of the FA acknowledging the results of the FA. On 12 Sep 12, AFPC/DPSIM requested the applicant provide additional documentation to substantiate his claim; specifically, a signed memorandum by fitness test administrators attesting to what occurred during the run portion of the FA in question. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial indicating there is no evidence of an error or an injustice. Although the applicant provided a witness statement indicating he completed his run before 12:59, DPSIM cannot validate this against the FAC's log as the log does not indicate which runner was the witness, nor does it reflect anyone finishing the run with a time of 12:59. The closest participant finished the run at 13:04; while it is possible the witness's run was officially recorded as 13:04, there is no way to confirm this. Nor is there any way to confirm the validity of the timing information on the GPS printout. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 19 Apr 13, for review and comment within 30 days. As of this date, no response has been received by this office. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant contends the cardio component score for his 27 Jun 12 fitness assessment (FA) was incorrectly recorded. After a thorough review of the applicant’s complete submission, we believe that a preponderance of the evidence indicates that corrective action is warranted. In this respect, we note the applicant has provided a supporting statement from a fellow participant indicating the time recorded for the applicant must be erroneous as the applicant completed the run in close proximity to the witness who attained a passing score. While we note the comments of AFPC/DPSIM indicating that it is not possible to know for sure if the applicant’s score was incorrectly recorded, we find the supporting statement and copy of the excerpt from the fitness assessment cell (FAC) entry log sufficient to support the applicant’s version of the events in question and find it reasonable to conclude the applicant’s time was erroneously re-recorded when he ventured back onto the track after completing his FA to help another Airman do the same. Therefore, to preclude the possibility of an injustice to the applicant, we recommend that his records be corrected as indicated below ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his Fitness Assessment, dated 27 Jun 12, be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2012-03846 in Executive Session on 13 Jun 13, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the record as recommended.
