RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-03972 COUNSEL: NONE HEARING DESIRED: NOT INDICATED _________________________________________________________________ APPLICANT REQUESTS THAT: His narrative reason for separation of “Personality Disorder,” separation code of “JFX,” and reentry (RE) code of “2C” which denotes “Involuntary separated with an honorable discharge; or entry-level separation without characterization of service” be changed to allow him the opportunity to enlist with the United States Army. _________________________________________________________________ APPLICANT CONTENDS THAT: He was having family problems and does not have a personality disorder. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 20 Mar 07, the applicant enlisted in the Regular Air Force. On 29 Mar 07, the applicant was diagnosed with an Adjustment Disorder with Depressed Mood by the Behavioral Analysis Service (BAS), which was so severe that his ability to function effectively in the military environment was significantly impaired. On 2 Apr 07, the applicant was notified of his commander’s intent to recommend that he be discharged from the Air Force under the provisions of AFPD 36-32, Air Force Military Training and AFI 36-3208, Administrative Separation of Airmen, paragraph 5.11.9, Conditions that Interfere with Military Service. The commander recommended he receive an entry-level separation. The applicant acknowledged receipt of the notification of discharge. At that time, the applicant waived his right to seek legal counsel and to submit a statement in his own behalf. 0n 3 Apr 07, the Assistant Staff Judge Advocate reviewed the case file and determined it was legally sufficient to support discharge. On 4 Apr 07, the discharge authority directed the applicant be discharged from the Air Force with an uncharacterized entry-level separation. He served 17 days of total active duty. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOR recommends approval of the applicant’s request to change his narrative reason for separation and separation code. DPSOR states a review of the applicant’s record reveals there was an error in his separation record. Specifically, the applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty, incorrectly reflects he was discharged with a separation code of “JFX” and a narrative reason of “Personality Disorder.” Since the applicant was diagnosed with an “Adjustment Disorder with Depressed Mood,” his DD Form 214 should have reflected a separation code of “JFY” and narrative reason for separation of “Adjustment Disorder.” The complete DPSOR evaluation is at Exhibit C. AFPC/DPSOA recommends denial of the applicant’s request to change his RE code. DPSOA states the applicant’s RE code 2C is required in accordance with (IAW) AFI 36-2606, Reenlistments in the USAF, based on his involuntary discharge with uncharacterized service. The applicant does not provide proof of an error or injustice in reference to his RE code. The complete DPSOA evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states he was raised in the military. His father, grandfather and step-father all served in the military. His grandfather had a huge influence on his life. He learned everything from work ethics to being a man from his grandfather. He grandfather was a “father figure” when his parents divorced. The bond they shared was immensely important, strong and inseparable. While attending basic military training (BMT) he received a letter informing him that his grandfather was ill. He wanted to go home and say goodbye but was told no because his grandfather was not considered his immediate family. He wanted to be there for his grandfather, so he signed forms stating he had a “Personality Disorder.” The applicant’s complete response is at Exhibit F. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice to warrant changing the applicant’s RE code. In this respect, we note the RE code issued in conjunction with his entry-level separation appropriately identifies the fact that he was involuntarily discharged with uncharacterized characterized service. In view of the above and in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. 4. Notwithstanding the above, sufficient relevant evidence has been presented to demonstrate the existence of an injustice to warrant changing the narrative reason for his separation to “Adjustment Disorder.” We note the applicant’s records indicate he was administratively separated under the provisions of AFI 36-3208, with the reason for his discharge being “Personality Disorder.” However, after reviewing the evidence of record, it appears the applicant’s narrative reason for separation inaccurately reflects the circumstances surrounding his discharge. Since the applicant was actually diagnosed with an Adjustment Disorder with Depressed Mood, AFPC/DPSOR recommends his narrative reason for separation be changed to “Adjustment Disorder,” along with the corresponding separation code of “JFY.” We agree with the opinion and recommendation of AFPC/DPSOR to change the applicant’s records to reflect the more appropriate narrative reason for separation, which more accurately identifies the circumstances surrounding his separation. Therefore, we recommend his records be corrected to the extent indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that he was discharged on 6 Apr 07, with a narrative reason for separation of “Adjustment Disorder,” rather than “Personality Disorder,” and a separation code of “JFY,” rather than “JFX.” ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2012-03972 in Executive Session on 21 May 13, under the provisions of AFI 36-2603: Panel Chair Member Member All members voted to correct the records, as recommended.
