RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04129 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: He be credited with four points for a satisfactory year of service for retention/retirement (R/R) year 2010/2011. ________________________________________________________________ APPLICANT CONTENDS THAT: He was not eligible for promotion because he was unable to attain a satisfactory year of service for R/R year 2010-2011. He was switching units and was unable to attend unit training assemblies during June-August 2011. In view of this, he completed training for points only that was required for his Air Force Specialty Code (AFSC) 4H0X1 Career Field Education and Training Plan (CFETP). He submitted the AF Form 40A, Record of Individual Inactive Duty Training; however, his commander indicated the form needed to be signed by his former unit commander. Unfortunately, his former unit commander refused to sign the form and his request was disapproved by the Air Reserve Personnel Center (ARPC). The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Air Force Reserve in the grade of senior airman (SrA). According to information extracted from the Military Personnel Data System (MilPDS), the applicant accrued 31 inactive duty training (IDT) points and 15 membership points for a total of 46 retirement points during the contested R/R year, which does not constitute a satisfactory year of service. The applicant has been credited with three years of satisfactory Reserve service for retirement. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibits C. ________________________________________________________________ AIR FORCE EVALUATION: AFRC/A1K recommends denial indicating there is no evidence of an error or injustice. The applicant has not provided any documentation showing he has met all the requirements to be eligible for promotion. In accordance with the governing instruction, AFI 36-2254VI, Reserve Personnel Participation, service members should complete Inactive Duty Training (IDT) at the unit they are assigned or attached, unless an adequate facility or equipment are not available. If the service member received approval in advance from his commander he can attend training at an alternate site. The applicant has not provided any documentation showing he received advance approval for the training he attended. Additionally, in order for an enlisted Air Force Reserve member to be eligible for promotion to staff sergeant they must meet a variety of eligibility requirements, including the attainment of four years of satisfactory service for retirement. However, the applicant has provided no documentation to indicate that he meets the requirements for promotion. Furthermore, the service member must also be recommended by the assigned supervisor and approved by the commander. It is at the supervisor’s discretion to recommend the service member for promotion to the commander. A complete copy of the AFRC/A1K evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 14 December 2012, for review and comment within 30 days. As of this date, no response has been received by this office. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. Although there is no evidence of an error on the part of the Air Force, we believe it is in the interest of justice to recommend granting the requested relief. In this respect, we find it reasonable to conclude the applicant’s transfer between units hindered his opportunity to participate in unit training assemblies during the period in question. Furthermore, we believe the applicant made a reasonable effort to perform training in kind in an effort to ensure he would be credited with a satisfactory year of Reserve service. Therefore, in view of the above, we recommend his records be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that he was awarded an additional four inactive duty training points for retention/retirement year 23 June 2010 to 22 June 2011, resulting in 50 total points, which constitutes a satisfactory year of Federal service. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2010-02838 in Executive Session on 23 May 2013, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records as recommended.
