RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04193 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: 1. He be awarded the Republic of Vietnam Campaign Medal (VCM). 2. His dates of his Air Force Good Conduct Medal (AFCGM) be changed to encompass his entire active duty service. ________________________________________________________________ APPLICANT CONTENDS THAT: He served during the “Vietnam Campaign” assigned to 8th Air Force, Strategic Air Command (SAC). His AFGCM should be changed from 9 Apr 74 through 8 Apr 77 to 9 Apr 74 through 8 Apr 78 to encompass his entire active duty service. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant’s military personnel records indicate he enlisted in the Regular Air Force on 9 Apr 74. According to the applicant’s DD Form 214, Report of Separation from Active Duty, he served from 9 Apr 74 to 8 Apr 78 and was credited with four years of total active service, which included two months and five days of foreign service. According to the applicant’s DD Form 214, he was awarded the AFGCM for the period of 9 Apr 74 through 8 Apr 77. The RVCM is awarded to members of the armed forces who, during the period 1 Mar 61 through 28 Mar 73, served for at least six months in South Vietnam; or served outside the geographical limits of South Vietnam and contributed direct combat support to the RVN armed forces for an aggregate of six months. The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility (OPR) which is attached at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial, indicating there is no evidence of an error or injustice. After a thorough review of the applicant’s official military personnel record and documentation provided, they were unable to verify his entitlement to award of the VCM. The applicant did not serve during the qualifying period of the RVCM. As for his request pertaining to the AFGCM, it is awarded for a three year period of qualifying service; therefore, the applicant’s DD 214 accurately reflects the appropriate timeframe for his AFGCM. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Apr 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
