RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05047 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His 12 Oct 12 Fitness Assessment (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: The fitness monitor incorrectly counted the number of laps he completed during the fitness assessment. He was performing the one and half mile run on an indoor track and was required to complete 11 and 3/4 laps. While running what he believed was his last lap the evaluator informed him he had another lap to complete. Upon completing the lap he voiced his concerns regarding the number of laps he completed. The evaluator told him the count was correct. The time keeper stated he verified the count and it was correct. He felt he had to sign the evaluation certificate due a possible retest in 5 days and an upcoming temporary duty assignment. In support of his request, the applicant provides a copy his Air Force Individual Fitness Assessment History. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of technical sergeant (E-6). In order to receive a satisfactory rating the applicant needed to earn an overall composite score of 75 or greater along with the minimum value in each of the four components: Aerobic Fitness, Body Composition, and Muscular Fitness. On 12 Oct 12, the applicant completed the contested FA and attained an overall score of 71.50; however, as he completed the cardio component of the FA in 13:41, which is above the maximum time allowed for his age group of 13:14, he attained an overall unsatisfactory assessment. The applicant’s last five cardio and FA results are as follows: Date Cardio Results Composite Score Rating 18 Oct 12 12:41 82.20 Satisfactory 12 Oct 12 13:41 71.50 Unsatisfactory 16 Apr 12 12:37 83.10 Satisfactory 19 Oct 11 11:33 88.90 Satisfactory 30 Aug 11 13:38 71.90 Unsatisfactory On 6 Dec 12, AFPC/DPSIM requested the applicant provide additional documentation to substantiate his claim, specifically a signed memorandum from the testing administrators commenting on the circumstances of the run portion of the contested FA. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial indicating there is no evidence of an error or injustice. Other than his own assertions, the applicant has not provided any documentation to support his request. Absent evidence to substantiate the applicant’s request, the validity of his claim cannot be determined. Also, based on applicant's fitness history, the run time for the contested FA is within his normal range. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 May 13, for review and comment within 30 days. As of this date, no response has been received by this office. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We noted the recommendation by the Air Force office of primary responsibility. However, after thoroughly reviewing the applicant’s submission and his accounting of the contested Fitness Assessment, we find it reasonable to conclude that the cardio component of the contested FA was erroneously administered. In this respect, we note the time recorded is inconsistent with his performance in past and subsequent FAs, which he easily passed. Therefore, to preclude the possibility of an injustice to the applicant, we recommend his 12 Oct 12 Fitness Assessment score be removed from the AFFMS. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Fitness Assessment, dated 12 October 2012, be declared void and removed from the Air Force Fitness Management System (AFFMS) database. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2012-05047 in Executive Session on 30 Jul 13, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records as recommended.
