RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05218 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect the names and dates of his foreign duty stations. _________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214 does not reflect the names and dates of his foreign duty stations. In support of his request, the applicant provides a copy of his DD Form 214. The applicant's complete submission, with attachment, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 24 Mar 66, the applicant entered the Regular Air Force. He served a total of 3 years and 10 months on active duty, with 1 year, 1 month and 11 days being Foreign Service. On 5 Mar 13, AFPC/DPSOR notified the applicant that in accordance with (IAW) governing directives, a DD Form 214 will not be reissued or amended showing specific locations served in the area of responsibility (AOR). On 10 Dec 12, DPAPP was able to verify one temporary duty (TDY) assignment to U-Tapao Air Base, Thailand from 16 Jul 69 to 14 0ct 69, for 2 months and 29 days. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP states that the Board should review the applicant’s records to see if Foreign Service other than what they were able to verify can be determined. DPAPP states that they were not able to verify any other TDY assignment to Southeast Asia (SEA). The complete DPAPP evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states that his AF Form 7, Airman Military Record reflects he was TDY from 28 Mar – 23 May 68, for 57 days to SEA, 7 Dec 68 - 4 Jan 69, for 29 days to SEA in addition to the 2 months and 29 days DPAPP was able to verify. The applicant states that all his TDY’s were to U-Tapao, Air Base, Thailand. The applicant’s complete submission, with attachment, is at Exhibit D. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant granting relief. The applicant requests that his DD Form 214 be corrected to reflect his Foreign Service duty locations during the period 1996 to 1970. While we note, the applicant has already been advised that IAW DoD directives, the DD Form 214 will not be reissued or amended to reflect specific locations served in an AOR. However, according to his AF Form 910, TSgt, SSgt, and Sgt Performance Report ending 14 Oct 69, the applicant performed duty in direct support of the Southeast Asian Conflict from 16 Jul 69 to 14 Oct 69. Moreover, AFPC/DPAPP was able to verify one TDY assignment to U-Tapao Air Base, Thailand from 16 Jul 69 to 14 Oct 69, for 2 months and 29 days. We note the applicant’s AF Form 7, Airman Military Record does not list the specific location of his TDY; however, it supports the applicant’s contentions and is consistent with the dates contained in his EPR ending 14 Oct 69. As such, we find the evidence submitted is sufficient to conclude the applicant had boots-on-ground in Thailand from 16 Jul 09 thru 14 Oct 09. The applicant contends he performed two additional TDYS to Thailand from 28 Mar 68 to 23 May 68 and 7 Dec 68 to 4 Jan 69, however, we cannot determine the exact location. Should the applicant provide official documentation to substantiate his claim for award of additional Foreign Service time we would be willing to reconsider his request. Therefore, we recommend his records be corrected only to the extent indicted below. ______________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that he had boots-on-the-ground in Thailand from 16 July 1969 through 14 October 69. _________________________________________________________________ The following members of the Board considered Docket Number BC-2012-05218 in Executive Session on 27 Aug 13, under the provisions of AFI 36-2603: Panel Chair Member Member All members voted to correct the records as recommended.
