RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05615 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His 4 Oct 12 Fitness Assessment (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: He suffered an injury during the cardio portion of his FA, pulling a hamstring muscle. Because he did not “fall out,” but finished the run he received an unsatisfactory grade. The applicant’s complete submission, with attachment, is at Exhibit A. _________________ ______________________________________________ STATEMENT OF FACTS: The applicant served in the Air Force in the grade of Senior Airman Sergeant (E-4) during the matter under review. On 5 Oct 12, the applicant’s physician completed an Air Force Form 469, Duty Limiting Condition Report, restricting him from running over 200 yards for a 30-day period. On 18 Oct 12, the applicant’s physician completed an AF Form 108, Physical Fitness Education and Intervention Processing, indicating the applicant had a medical condition precluding the achievement of a passing fitness score. The applicant’s FA results are as follows: Date Composite Score Rating 1 Jan 13 83.20 Satisfactory 4 Oct 12 70.70 Unsatisfactory 16 Mar 12 86.90 Satisfactory 8 Dec 10 90.90 Excellent The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility, which is included at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial of the applicant’s request, indicating there is no evidence of an error or injustice. IAW AFI 36-2905, Fitness Program, “If an Airman becomes injured or ill during an FA and is unable to complete all required components, he/she will have the option of being evaluated by the Medical Treatment Facility (MTF) but his/her test will still count unless rendered invalid by the Unit Commander. If the medical evaluation validates the illness/injury, the Unit Commander may invalidate the test results.” While the MTF validated the applicant was injured, he completed the FA. The applicant’s completing the assessment made him ineligible for the commander to invalidate his test result. In addition, the applicant did not submit evidence to show his commander wished to invalidate the FA. A complete copy of the AFPC/DPSIM evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 8 Mar 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case. While the Board notes the recommendation from AFPC/DPSIM to deny the applicant’s request, we believe the AF Form 108, Physical Fitness Education and Intervention Processing, dated 18 Oct 12, signed by both a medical provider and the applicant’s unit commander stating the applicant had “a medical condition precluding the achievement of a passing fitness score,” constitutes sufficient justification to warrant removal of the contested FA score. Therefore, we recommend the applicant’s record be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show his Fitness Assessment (FA), dated 4 October 2012, be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2012-05615 in Executive Session on 19 Dec 13, under the provisions of AFI 36-2603: , Chair , Member , Member All members voted to correct the records, as recommended.
