RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05677 XXXXXXX COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: 1. He be awarded the Meritorious Unit Commendation (MUC) (Army). 2. He be awarded two Bronze Service Stars (2BSSs) for his previously awarded Iraq Campaign Medal (ICM) – Administratively Corrected. ________________________________________________________________ APPLICANT CONTENDS THAT: He should have been awarded the MUC (Army) for his assignment to a military police battalion and 2BSSs for his deployment with an expeditionary security forces squadron, Iraq, from 11 Aug 06 to 1 Mar 07 in support of Operation IRAQI FREEDOM (OIF). However, the MUC and the BSSs for the ICM were not approved until after he had separated. In support of his appeal, the applicant provides copies of his separation documents; decoration recommendation for the Army Commendation Medal, and other additional documents associated with his request. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a former enlisted member of the Regular Air Force, who served on active duty from 30 Jan 02through 28 Jan 08. AFPC/DPSIDR will administratively correct the applicant’s record to reflect award of the ICM, w/2 BSSs. ________________________________________________________________ THE AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial of the applicant’s request for award of the Meritorious Unit Commendation (Army). There is no documentation assigning or attaching the applicant to an army unit that was awarded the Meritorious Unit Commendation (Army). To grant award of the Meritorious Unit Commendation (Army) would be contrary to the criteria established by DoDM 1348.33. DPSID notes that based on their review of the applicant's official military personnel record, they were able to determine the applicant should have been awarded the ICM, w/2BSSs for his service from 30 Jan 02 to 28 Jan 08 and was not reflected in his records. Upon the final board decision, administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR. The complete DPSID evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Feb 13 for review and response. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice in respect to the applicant’s entitlement to the award of the Meritorious Unit Commendation (Army). We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that which will be corrected administratively is not warranted.
