RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05683 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge be corrected to reflect his medals and decorations for his service in Da Nang, Vietnam. _________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214 does not reflect his medals and decorations for his service in Vietnam. In support of his request, the applicant provides copies of his DD Form 214, DD Form 1351-2, Travel Voucher or Subvoucher, and photographs. The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 23 Apr 65, the applicant entered the Regular Air Force. He is credited with 11 months and 16 days of Foreign Service. On 16 Jan 13, AFPC/DPAPP notified the applicant that they were unable to verify any service in the Republic of Vietnam. However, they were able to verify and confirm Foreign Service boots-on-the-ground (BOG) at Nakhon Phanom, Royal Thai Air Force Base, Thailand. His DD Form 214 reflects that he served in Thailand from 29 Nov 67 to 14 Nov 68 for a period of 11 months and 16 days. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial of the applicant’s request to have his records corrected to reflect service in Vietnam. A review of the applicant’s master personnel records and documentation provided failed to substantiate Foreign Service time in Vietnam. The complete DPAPP evaluation is at Exhibit C. AFPC/DPSID makes no recommendation. DPSID states that based on a review of the applicant’s records he should have been awarded the Vietnam Service Medal with one Silver Star (VSM w/1SS), the Vietnam Campaign Medal (VCM), and the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) during his service from 23 Apr 65 to 14 Nov 68 and his records will be administratively corrected. The complete DPSID evaluation, with attachment, is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 19 May 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit E). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After thoroughly reviewing the evidence of record and noting the applicant’s contentions, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted. In view of the above and in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The applicant be notified that the evidence presented dis not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. _________________________________________________________________ The following members of the Board considered Docket Number BC-2012-05683 in Executive Session on 5 Sep 13, under the provisions of AFI 36-2603: Panel Chair Member Member All members voted to correct the records, as recommended.
